YK:n pääsihteeri on 1.7.2012 toimittanut kirjeellään muutosehdotukset sopimuspuolille virallisesti tiedoksi ja hyväksyttäviksi. Muutosehdotukset katsotaan hyväksytyksi, ellei 1.10.2012 mennessä vähintään viisi sopimuspuolta ole kirjallisesti ilmoittanut vastustavansa muutosehdotusta. Jos muutokset katsotaan hyväksytyksi, ne tulevat voimaan 1.1.2013 sisältäen 6 kuukauden siirtymäajan. Kansainvälisiä rautatiekuljetuksia koskevan yleissopimuksen (COTIF) liitteen C määräysten (RID-määräykset) muuttaminen: Kansainvälisten rautatiekuljetusten järjestön (OTIF) vaarallisten aineiden rautatiekuljetuksia käsittelevä RID-asiantuntijakomitea on hyväksynyt muutoksia RIDmääräyksiin 50. ja 51. kokouksissaan. OTIF:n pääsihteeri on toimittanut jäsenvaltioille 4.7.2012 kirjeen, jossa todetaan muutosten tulevan voimaan 1.1.2013, ellei neljäsosa jäsenmaista vastusta ehdotettuja muutoksia 4.11.2012 mennessä. Muutettuja määräyksiä koskee kuuden kuukauden siirtymäaika. Vaarallisten aineiden sisämaakuljetuksista annetun Euroopan parlamentin ja neuvoston direktiivin (EY) N:o 2008/68/EY (VAK-direktiivi) muuttaminen: VAK-direktiivin 1-3 liitteitä muutetaan syksyn aikana siten, että niissä viitataan em. muutettuihin ADR-sopimuksen määräyksiin ja RID-määräyksiin sekä vaarallisten
2(5) aineiden kuljetusta sisävesillä koskevan ADN-sopimuksen määräyksiin. Suomi ei ole mukana ADN-sopimuksessa, jolloin VAK-direktiivin liitteen 3 muutokset eivät koske Suomea. Tämä muutosprosessi ei ole vielä käynnistynyt. Direktiivillä ADR-sopimuksen määräykset ja RID-määräykset ja niiden muuttaminen on siirtynyt EU:n toimivaltaan. EU on osapuolena COTIF-yleisopimuksessa. ADR-sopimuksen osapuolena EU ei ole. VAK-direktiivin 1-3 liitteitä muutetaan direktiivin 9 artiklan 3 kohdan mukaan neuvoston komitologiapäätöksen (1999/468/EY) 5a artiklan mukaisessa valvonnan käsittävässä sääntelymenettelyssä. Käsittelijä(t): Suomen kanta/ohje: Pääasiallinen sisältö: LVM, Seija Miettinen, p. 0295342563 LVM, Kaisa Männistö, p. 0295342030 Suomi hyväksyy vaarallisten aineiden tie- ja rautatiekuljetuksia koskevat ADRsopimuksen A ja B liitteisiin sekä COTIF-sopimuksen C liitteeseen esitetyt muutokset sekä vastaavat muutokset EU:n VAK-direktiiviin. ADR-sopimuksen määräyksiin tehdyt muutosehdotukset: Muutoksissa on huomioitu YK:n vaarallisten aineiden kuljetuksia koskevat mallisäännökset (17. tarkastettu painos). Erityisesti on täsmennetty YK:n mallisääntöjen mukaisesti radioaktiivisten aineiden turvamääräyksiä ja lisätty noin kymmenen uuden vaarallisten aineiden nimikkeet ja niiden kuljetusehdot. Muutosehdotukset koskevat lähinnä teknisiä yksityiskohtia, kuten joidenkin vaarallisten aineiden luokituskriteereitä, pakkauksia ja säiliöitä sekä ajoneuvojen sähkökytkentöjä koskevia määräyksiä, käsisammuttimia koskevia täsmennyksiä ja pakollisina sovellettavien standardien nimikkeitä. Lisäksi sallitaan epäherkän räjähteen (ANFO) kuljettaminen alumiinisäiliössä ja täsmennetään koneisiin liittyviä polttoainesäiliöitä koskevia määräyksiä.
Ehdotetuilla muutoksilla lähennetään tiekuljetuksia koskevia määräyksiä muita kuljetusmuotoja koskevien kansainvälisten määräysten kanssa. Tämä helpottaisi eri kuljetusmuodoissa tapahtuvaa kemikaalien kuljetusta. 3(5) Edellä kuvattujen muutosten lisäksi ADR-sopimuksen määräyksiin tulisi lukuisa määrä lähinnä teknisiä muutoksia, joissa huomioidaan tieteen ja tekniikan kehitys. Liikenne- ja viestintäministeriö on osallistunut edellä kuvattujen ADR-sopimuksen liitteiden A ja B muutosten valmisteluun edellä mainitun ECE:n työryhmän kokouksissa. RID-määräyksiin tehdyt muutosehdotukset: Muutoksissa on huomioitu YK:n vaarallisten aineiden kuljetuksia koskevat mallisäännökset (17. tarkastettu painos). Erityisesti on täsmennetty YK:n mallisääntöjen mukaisesti radioaktiivisten aineiden turvamääräyksiä ja lisätty noin kymmenen uuden vaarallisten aineiden nimikkeet ja niiden kuljetusehdot. Ehdotetuilla muutoksilla lähennetään rautatiekuljetuksia koskevia määräyksiä muita kuljetusmuotoja koskevien kansainvälisten määräysten kanssa. Tämä helpottaisi eri kuljetusmuodoissa tapahtuvaa kemikaalien kuljetusta. Edellä kuvattujen muutosten lisäksi RID-määräyksiin tulisi lukuisa määrä lähinnä teknisiä muutoksia, joissa huomioidaan tieteen ja tekniikan kehitys. Liikenne- ja viestintäministeriö ja Liikenteen turvallisuusvirasto ovat osallistuneet edellä kuvattujen RID-määräysten muutosten valmisteluun RID-asiantuntijakomitean kokouksissa. Kansallinen käsittely: Taloudelliset vaikutukset: Liikennejaoston (EU22) kirjallinen menettely 3.-7.9.2012. Koska ADR-sopimuksen määräykset ja RID-määräykset sekä niiden muuttaminen kuuluvat EU:n toimivaltaan, muutosehdotukset on tarkoitus hyväksyä valtioneuvoston istunnossa. Valtioneuvoston ohjesäännön (VNOS) 3 :n 9 kohdan mukaan valtioneuvoston yleisistunto ratkaisee Euroopan unionissa päätettäviin asioihin sekä niihin sisällöltään ja vaikutuksiltaan rinnastettaviin asioihin liittyvät toimenpiteet, jos ne edellyttävät valtioneuvoston päätöstä. Muutokset eivät sisällä lainsäädännön alaan kuuluvia kysymyksiä. Muutosten hyväksymisen jälkeen vastaavat muutokset tehdään valtioneuvoston ja liikenne- ja viestintäministeriön asetuksiin vaarallisten aineiden kuljetuksesta rautateillä VAK-direktiivin edellyttämällä tavalla. Reference: C.N.344.2012.TREATIES-XI.B.14 (Depositary Notification) EUROPEAN AGREEMENT CONCERNING THE INTERNATIONAL CARRIAGE OF DANGEROUS GOODS BY ROAD (ADR) GENEVA, 30 SEPTEMBER 1957 PROPOSAL OF AMENDMENTS BY PORTUGAL TO ANNEXES A AND B, AS AMENDED The Secretary-General of the United Nations, acting in his capacity as depositary, communicates the following: The Government of Portugal, in accordance with paragraph 1 of article 14 of the above Agreement, has transmitted to the Secretary-General the text of the proposed amendments to Annexes A and B, as amended, to the above Agreement. (It will be recalled that the text of these proposed amendments had been approved by the Working Party on the Transport of Dangerous Goods of the Economic Commission for Europe at its 88 th, 89 th, 91 st and 92 nd sessions). The procedure for the amendment of annexes to the Agreement is set forth in its article 14, in particular, in paragraphs 2 and 3, which read as follows: 2. The Secretary-General shall transmit any proposal made under paragraph 1 of this article to all Contracting Parties and inform thereof the other countries referred to in article 6, paragraph 1. 3. Any proposed amendment to the annexes shall be deemed to be accepted unless, within three months from the date on which the Secretary-General circulates it, at least one-third of the Contracting Parties, or five of them if one-third exceeds that figure, have given the Secretary-General written notification of their objection to the proposed amendment. If the amendment is deemed to be accepted, it shall enter into force for all the Contracting Parties, either on the expiry of a further period of three months or, in cases where similar amendments have been or are likely to be made to the other international agreements referred to in paragraph 1 of this article, on the expiry of a period the duration of which shall be determined by the Secretary-General in such a way as to allow, wherever possible, the simultaneous entry into force of the amendment and those that have been or are likely to be made to such other agreements; such period shall not, however, be of less than one month s duration. Consequently, unless the proposed amendments to the Annexes are deemed rejected pursuant to article 14 (3) within three months from the date of the notification, i.e., on 1 October 2012, the Secretary-General proposes that the amendments in question enter into force on 1 January 2013.
