8 Uutuudet vm 2015 Uusi Alde 3020 vesikiertolämmitys Vm 2015 Hobby asentaa vaunuihin uuden Alde 3020 vesikiertolämmityksen. Alden ohjauspaneeli on myös uusi. Hobbyssa ALDE Smart Control-toimintoa voi käyttää erillisen kytkentämoduuliin avulla. Älykäs ohjauspaneeli Vakiovarusteinen ohjauspaneeli muuttuu älykkääksi. Siitä tulee täysin BUS** yhteensopiva ja siihen tulee 5-puolainen liitin. Paneeliin tulee myös lapsilukko. Samaa koskee LCD- ja W-Lan paneeleja, kaikki toiminnot sovitetaan yhteen.. * CI BUS = Caravan Industrie BUS** ** BUS = Binary Utility System 7

9 Uutuudet vm 2015 Bus-järjestelmä vapaa-ajan ajoneuvoissa BUS-järjestelmän edut Useiden toimintojen ohjaus ja seuranta keskitetysti yhdeltä näytöltä Pienempi kaapelointitarve vaunussa Kaikkien komponenttien relevantit toiminnot käytettävissä (Pääkatkaisin päälle/pois; Verkkovirta käytettävissä) Vaunuvalmistaja voi yhdistää eri valmistajien laitteita yhteiseen ohjaukseen Hobby CI-BUS-Ohjaus LCD-paneelista Uudenaikainen BUS ohjausjärjestelmä ohjaa kaikkia laitteita ja toimintoja vaunun omassa verkossa. Laitteen ohjain mahdollistaa mukavan navigoinnin eri valikkojen välillä. Näytöltä luettavissa tiedot kuten Pvm/aika/sisä- ja ulkolämpötila, vesitankin täyttömäärä, akun latauksen taso. Lisäksi toimintoja kuten lämmitys, ilmastointi, sähköiset kattoluukut voi ohjata keskitetysti. Järjestelmä on standardoitu ja päivitettävissä. Jo nyt 15 eri laitetta voi kommunikoida ohjauspaneelin kanssa. W-LAN Ohjauspaneeli W-LAN moduliin avulla kaikkia LCD-paneelin toimintoja voi ohjata langattomasti älypuhelimen tai tablettitietokoneen kautta, esim valaistus, ilmastointilaite, lämmitin ja lämminvesi.. Edelleen kehitetty kattoilmastointilaite 8

11 Uutuudet vm 2015 Valaistuksen näyttelytila Valaistuksen voi ohjelmoida näyttelytilaan. Päälle: Pois: Paina pidempään Lämmitys, lattialämmitys ja Ambiente1 Paina pidempään Lämmitys, lattialämmitys ja etuteltan valaistus Kaikki valot syttyvät automaattisesti kun virran kytkee päälle. Vaikka valoja sitten sammutetaan/laitetaan päälle vaunussa, palaa näyttelytila, jossa kaikki valot palaavat, noin minuutin päästä. Valojen ohjaus Valastuksen ohjausta on laajennettu ja uudistettu. Uusi 12V- pistokerasia joka ei ohjaudu pääkytkimestä (radio, Alde, jne.) Kaikki rasiat/ulostulot on lisäksi varmistettu sähköisellä suojakytkimellä. Nämä suojaavat myös kaikkia valaiaimia jne. Järjestelmä on täysin CI-BUS yhteensopiva. Näin ollen lukuisat toiminnot ovat paremmin ohjattavissa. Uudet ulkopistorasiat Kaikissa mallisarjoissa uudentyyppiset ulkopistorasiat. 10

21 Our GTC General Terms and Conditions for the Sale of Brand New Caravans I. General Field of Application 1. All goods and services provided by us are exclusively subject to our General Conditions of Sale as set out below; we do not acknowledge any contrary or deviating conditions of the buyer, unless we have expressly agreed thereto in writing. Our Conditions of Sale apply even if, in knowledge of contrary or deviating conditions of the buyer, we undertake delivery to the buyer without reservation. 2. All agreements reached between us and the buyer upon conclusion of the contract are set down in writing in the contract including the present Conditions of Sale. Our employees are not authorised to issue verbal commitments that deviate from the written contractual agreement. 3. Our Conditions of Sale apply only vis-à-vis entrepreneurs within the meaning of 14 of the German Civil Code [BGB], legal entities under public law, and special funds under public law. 4. Our Conditions of Sale apply in respect of all present and future business relations with the buyer. II. Conclusion of contract, transfer of buyer s rights and duties 1. Our offers are non binding. Technical changes (particularly changes in design and form) and variations in colour remain reserved, within reasonable limits. 2. If the order placed by the buyer is to be described as an offer, the buyer is bound by the terms of the offer for a period of three weeks. The conclusion of the purchase contract is effected either by our written confirmation of acceptance of the order without reservation or our execution of the delivery within the aforementioned period. 3. The transfer of the buyer s rights and duties arising from the purchase contract requires our prior written agreement. III. Prices, payment conditions 1. Unless otherwise stated in the order confirmation, our prices are regarded as ex works. 2. Statutory VAT is not included in our prices; the applicable statutory amount is shown separately in the invoice. 3. The deduction of a discount requires special written agreement. 4. The purchase price and prices for ancillary services are due for payment upon handover of the purchase item (or not later than 8 days after receipt of notice of readiness) and delivery or transmission of the invoice. 5. If part payments have been agreed, the residual amount owing is due for payment immediately if the buyer is in default with all or part of at least two successive 20

22 Our GTC instalments and the amount by which the buyer is in default is at least 1/10 of the purchase price. 6. The buyer can only offset amounts against our claims if his counter claims have been declared legally enforceable or are undisputed or have been acknowledged by us. In addition the buyer is authorised to exercise a right of retention insofar as his counter claim is based on the same contractual relationship. 7. In the event of default on the part of the buyer, interest is payable on the respectively outstanding amount at 8 percentage points above the basic interest rate p.a. Claims to reimbursement of any further damage due to default are not affected. 8. Payment instructions, cheques and bills are only accepted following special agreement, and only by way of payment with all collection and discount costs included. IV. Delivery conditions 1. The start of the delivery period as stated by us presupposes that all technical issues have been clarified. 2. The observance of our delivery obligation further presupposes timely and correct fulfilment of the buyer s obligations. The plea of unperformed contract ( 320 BGB) and the plea of uncertainty remain reserved. 3. In the event of the buyer s culpable default in acceptance, or in the event of culpable breach of other duties of cooperation by the buyer, we are entitled to demand compensation for the damage arising for us, including any additional expenditure. Further claims remain reserved. 4. Unless otherwise evident from the order confirmation, delivery is agreed as ex works. 5. All events of force majeure for which we are not responsible pursuant to 276 BGB release us from the performance of the contractual obligations accepted by us, for the entire duration of such events. We are obliged to inform the buyer immediately concerning the occurrence and provisional duration of any such event. If any such event continues for more than three months, each party is entitled to withdraw from the contract. The counter performance is reimbursed immediately. 6. If we are in default in respect of a delivery as a result of negligence, our liability for damages in addition to performance (damage due to delay) is limited to a maximum of 5 % of the delivery value, and for damages in place of performance to 25 % of the delivery value. Further claims of the buyer (including after the expiry of a grace period for performance) are excluded. Liability for culpable injury to life, limb or health is not affected. V. Withdrawal 1. The buyer can only withdraw from the contract, within the limits of the statutory provisions, if the breach of duty is attributable to us; in the case of defects (VII.), however, the statutory preconditions continue to apply. 2. In the event of breaches of duty, the buyer must state, within a reasonable period after we have asked him to do so, whether he is withdrawing from the contract because of the breach of duty or whether he insists on performance. 21

23 Our GTC VI. Reservation of title 1. We reserve title in regard to the purchased item until all payments arising from the business connection with the buyer have been received. If there is a current account relationship between us and the buyer, the reservation of title also relates to the acknowledged balance on the account at the time; the same applies if a balance is not acknowledged and a causal balance is used. 2. If the buyer acts in contravention of the contract, and in particular in the event of default in payment, we are entitled, following the setting of an appropriate grace period, to withdraw from the purchase contract and to demand the return of the purchased item; the statutory cases where a grace period is dispensed with (particularly if we cannot reasonably be expected to allow a grace period) are not affected. 3. The buyer must handle the purchased item carefully; in particular, he must at his own cost insure it adequately at its new value against damage through fire, water, hail and theft. If the buyer takes the purchased item into operation, he must take out comprehensive insurance for the duration of the reservation of title. If so requested, the buyer must immediately provide us with proof that such insurance has been taken out. If the buyer does not fulfil this obligation, in spite of written warning, we can take out the insurance at the buyer s cost. In this case the buyer must reimburse the insurance premiums to us. If maintenance and inspection works are necessary, the buyer must execute such works in a timely manner at his own cost. 4. In the event of seizure or other encroachment by third parties, the buyer must inform us immediately in writing, so that we can file an action pursuant to 771 of the German Code of Civil Procedure [ZPO]. If the third party is not able to reimburse us for the judicial and extrajudicial costs of an action pursuant to 771 ZPO, the buyer is liable for the loss arising for us. 5. The buyer is entitled to sell on the purchased item in the ordinary course of business; however, he as of now assigns to us all claims, in the amount of the final invoice amount (including VAT) of our claim, arising for him from the resale vis-à-vis his customers or third parties, irrespective of whether the purchased item is sold on without any further processing or after processing. The buyer remains empowered to collect this claim even after the assignment. Our authority to collect the claim ourselves is not affected. However, we undertake not to collect the claim as long as the buyer fulfils his payment obligations arising from the proceeds received, and if he is not in default, and in particular if no application has been made for the opening of insolvency proceedings and no suspension of payments has been effected. If such is the case, we can require the buyer to make the assigned claims and the debtors known to us, to provide all necessary information for collection, to hand over the relevant documents and to inform the debtors (third parties) of the assignment. 6. If the reservation of title or the assignment is not valid according to the law applicable at the place where the goods are located, the form of security that corresponds to the reservation of title or the assignment under this law is deemed to have been agreed. If the cooperation of the buyer is necessary to ensure this, the buyer must at our request take all measures at his own cost as are necessary to establish and maintain such rights. 7. We undertake, at the buyer s request, to release the security items to which we are entitled insofar as the realisable value of such items exceeds the claims to be secured by more than 10 %; the choice of items to be released rests with us. 22

24 Our GTC VII. Condition, liability for defects We are not liable for damage caused by: the fact that the purchased item has been improperly handled by the buyer or by third parties, and in particular has been improperly tampered with or repaired, the fact that the purchased item has not been fitted with suitable replacement, supplementary and accessory parts, or the fact that the buyer has not followed the regulations concerning the handling, maintenance and care of the purchased item (e.g. the operating instructions). Liability for defects does not extend to natural wear and tear. 2. Claims for defects do not apply if the deviation from the agreed condition or the impairment of usability is only minor. 3. In the context of statements of weight, deviations of up to 5% are possible. If special equipment is fitted, this will increase the tare weight and reduce the vehicle load capacity. 4. The buyer s rights arising from defects presuppose that the buyer has properly fulfilled his duties of examination and notification of defects as set out in 377 of the German Commercial Code [HGB]. Notification of defects must be in writing. The full burden of proof in respect of all conditions of entitlement, in particular in respect of the defect itself, the date of occurrence of the defect, and the timeliness of the notification of the defect, rests with the buyer. 5. In the event of a defect we reserve the right to choose the nature of the subsequent performance. 6. The warranty period for claims for defects is 12 months from the date of delivery of the item. By way of deviation, the statutory warranty period of two years applies in respect of claims for compensation on the basis of intentional or grossly negligent breaches of duty and in the cases envisaged in IX The limitation period in the event of recovery from the supplier pursuant to 478, 479 BGB is not affected; this period is five years from the delivery of the defective item. Recourse claims against us pursuant to 478 BGB (Recourse of the entrepreneur) apply only insofar as the buyer has not concluded any agreement with his customer that extends beyond the statutory claims for defects. The buyer should only execute justified subsequent performance claims of his customers after prior consultation and in agreement with us; the buyer must inform us beforehand of the provisional costs of the subsequent performance. Any separate subsequent performance to which we have not given our prior written agreement is undertaken by the buyer at his own risk. VIII. Return of spare parts, accessories, tools and consumables 1. Spare parts, accessories, tools and consumables supplied by us are to be examined by the buyer immediately upon delivery for any incorrectly delivered items, defects and quantity deviations. 23

25 Our GTC 2. The buyer is entitled to return spare parts which he has ordered incorrectly within a period of 30 days following delivery. The buyer must ensure that the goods are properly packaged for return. Items are returned at the cost and risk of the buyer. The return of goods is deemed to constitute withdrawal from the contract. Manufactured parts cannot be returned. 3. If spare parts are returned to us for reasons which are not attributable to any fault on our part, we apply a re-stocking fee of 10% of the net value of the goods, the minimum charge being Euro In the event that any of the goods referred to in paragraph 1 are incorrectly delivered by us, the buyer has the statutory warranty rights in accordance with the provisions of sections VII. and IX. of the present conditions of sale. If the buyer demands a substitute delivery, the incorrectly delivered goods must be returned within 30 days of delivery, unless the buyer proves that the incorrect delivery was not ascertainable in the context of a properly conducted examination upon receipt of the goods. 5. The return of items outside of the 30-day period is only permissible after prior written agreement by the management of our spare parts warehouse. IX. Liability 1. We are liable in accordance with the statutory provisions if the buyer asserts claims for compensation that are based on malicious intent or gross negligence (including malicious intent or gross negligence on the part of our representatives or vicarious agents) or on any culpable breach of an essential contractual duty. Essential contractual duties are duties the fulfilment of which is essential to the achievement of the contractual purpose and which the buyer normally relies on and can reasonably expect to rely on. If no intentional breach of contract can be laid to our charge, the compensation liability in the aforementioned cases is limited to foreseeable and typically occurring damage. 2. Liability for culpable injury to life, limb or health is not affected; this applies also in respect of mandatory liability pursuant to the German Product Liability Act [Produkthaftungsgesetz]. 3. Unless otherwise agreed above, any further liability for damages other than as envisaged in the present section VIIII (sic) is excluded, irrespective of the legal nature of the claim being asserted. This applies in particular in respect of compensation claims based on other breaches of duty or compensation claims for material damage under the law of torts pursuant to 823 BGB. For liability due to delay, the limit on liability pursuant to IV 6 applies additionally. 4. The provisions of paragraphs 1 to 3 also apply if the buyer, instead of a claim for compensation for damage, demands reimbursement of useless expenditures in place of performance. 5. Insofar as our liability for damages is excluded or limited, this also applies in regard to the personal liability for damages of our managerial staff, wage earners, employees, representatives and vicarious agents. X. Place of jurisdiction, place of performance, applicable law 24

If the buyer is a businessman, the exclusive place of jurisdiction is our place of business; however, we are entitled also to bring action against the buyer at the court of his place of residence. 2. If the buyer is a businessman, and unless otherwise stated in the order confirmation, the place of performance for all obligations arising from the contract, including the buyer s duties of payment, is our place of business. 3. The law of the Federal Republic of Germany applies, to the exclusion of CISG. XI. Data protection o We are entitled to process and store the buyer s data relating to the respective purchase contracts, insofar as this is necessary for the execution and processing of the purchase contract and for as long as we are obliged to preserve such data on the basis of statutory requirements.
