2 (5) POSTI OY:N ETÄKAUPAN TOIMITUSEHDOT 1. Soveltamisala ja voimassaolo Näitä sopimusehtoja sovelletaan :n (jäljempänä Posti) ja kuluttaja-asiakkaan (myöhemmin Asiakas) väliseen etäkauppaan, ellei tuote- tai palvelukohtaisissa ehdoissa (myöhemmin tuotekohtaiset ehdot) ole toisin sovittu. Tuotekohtaisia ehtoja voidaan erillisten tuote-ehtojen lisäksi esittää tuotteen tarjoamisen yhteydessä ilman, että ehdot olisi erotettu tuotteen muusta kuvauksesta erilliseksi kokonaisuudeksi. Ehdot ovat voimassa toistaiseksi 13.6.2014 alkaen. 2. Sopimuksen syntyminen ja siirtäminen Sopimus syntyy, kun Posti on hyväksynyt Asiakkaan tekemän tilauksen. Postilla on ilman Asiakkaan suostumusta oikeus siirtää sopimus kokonaan tai osittain kolmannelle, jolle sopimuksen tarkoittama liiketoiminta siirtyy. Postilla on lisäksi oikeus siirtää sopimukseen perustuvat saatavansa kolmannelle. Postilla on oikeus perua tilaus, jos tilauksessa on selvä hintavirhe. Selvällä hintavirheellä tarkoitetaan mahdollista kirjoitus- tai muuta teknistä virhettä, jonka vuoksituotteen hinta poikkeaa merkittävästi ja selvästi tuotteen oikeasta hinnasta. Selviä hintavirheitä voivat olla muun muassa seuraavat esimerkit jos tuotteella on hinta 0,00 euroa tai ei hintaa ollenkaan jos kymmenien eurojen arvoisen keräily- tai lahjatuotteen hinnaksi ilmoitetaan esim. muutamia euroja. Em. tapauksissa virheellinen hinta on niin selkeästi oikeasta hinnasta poikkeava, että asiakkaan katsotaan ymmärtävän virheellisyys. 3. Toimitusaika ja -tapa Tuotteet lähetään pääsääntöisesti 3-5 arkipäivän kuluessa tilauksesta, ellei tuotekohtaisissa ehdoissa ole ilmoitettu muuta toimitusaikaa. Poikkeustapauksissa aika saattaa olla pidempi, tällöin asiasta kerrotaan palvelussa. Jos tilauksella on tulevaisuudessa ilmestyviä postimerkkejä tai tuotteita, nämä tuotteet toimitetaan ilmestymispäivän jälkeen ja toimitusaika lasketaan ilmestymispäivästä. Jos tilaus sisältää tuotteita, jotka ovat tilapäisesti loppuneet varastosta, ne toimitetaan jälkitoimituksina saatavuuden mukaan. Edellä mainituista syistä johtuen tilaus saatetaan toimittaa useammassa erässä. Tilauksen toimittaminen useammassa erässä ei vaikuta Asiakkaan maksettavaksi tuleviin toimituskuluihin. Enintään 2 kg painoiset lähetykset toimitetaan Priority- kirjeenä ja yli 2kg lähetykset Economy- pakettina, ellei tuotekohtaisissa ehdoissa ole toisin sovittu. 4. Toimituskulut Toimituskulut määräytyvät tuotteen, kokonaistilauksen ja toimitusmaan mukaan. Jos tuotteella on tuotekohtainen toimituskulu tai toimituskulu sisältyy hintaan, se on ilmoitettu tuotteen yhteydessä. Muuten toimituskulut on ilmoitettu maksutaulukossa. 5. Kuluttaja-asiakkaan peruutusoikeus ja palautukset Kuluttaja-asiakkaalla on oikeus 14 päivää tilauksen vastaanottamisesta tutustua tuotteeseen ja palauttaa se, mikäli se ei vastaa asiakkaan odotuksia. Palautettavan tuotteen on oltava samassa kunnossa kuin se toimitettiin. Kuluttaja voi ilmoittaa tilauksen peruuttamisesta ennen sen vastaanottamista Postin peruutuslomakkeella www.posti.fi. Posti katsoo tilauksen peruuttamiseksi myös tavaran palauttamisen peruutusajan aikana. Posti maksaa Manner-Suomessa tuotteen palautuskulut, kun tuote palautetaan peruutusaikana tai virheellisyyden vuoksi ja palautus tehdään Postin Asiakaspalautus-lähetyksenä. Ahvenanmaalta tai ulkomailta palautettaessa taikka muista kuin em. syistä palautettavien lähetysten kuljetusmaksuista Asiakas vastaa itse. 6. Reklamaatiot ja tiedustelut Asiakkaan tulee tarkastaa toimitus viipymättä vastaanotettuaan sen. Mahdollisista virheistä on ilmoitettava Postille kohtuullisessa ajassa siitä, kun Asiakas havaitsi tai hänen olisi pitänyt havaita virhe. Posti vastaa tuotteiden virheistä kuluttajille kuluttajansuojalain virhevastuusäännösten mukaisesti. Reklamaatiot ja tiedustelut osoitetaan Postin asiakaspalveluun: puh. 0200 71000, asiakaspalvelu@posti.com. 7. Asiakasrekisteri Verkkokaupan asiakkaiden nimi- ja yhteystiedot tallennetaan :n Kuluttaja-asiakasrekisteriin. Rekisterin tietoja käytetään rekisteriselosteessa kerrotulla tavalla. Rekisteriselosteen voi myös pyytää Postin Asiakaspalvelusta. Rekisteröityneiden asiakkaiden tiedot tallennetaan Asiakastietokantaan (rekisteriseloste).
3 (5) 8. Asiakasviestintä Posti voi lähettää asiakkaille sekä asiakaspalveluviestejä että markkinointiviestejä sähköpostiin ja matkapuhelimeen. Posti voi lähettää Asiakkaalle markkinointiviestejä sähköpostiin tai puhelimeen, jos Asiakas on sallinut tämän tai tilannut sähköistä kanavaa käyttäen. Asiakas voi kieltää henkilötietojensa käytön suoramarkkinointiin. kanne kotipaikkansa yleisessä alioikeudessa tai saattaa asia kuluttajariitalautakunnan käsiteltäväksi. 9. Kestotilaus Uusia postimerkkejä, ensipäivänkuoria ja eräitä postimerkkituotteita voi tilata kestotilauksena. Kestotilaukset toimitetaan tilauksen sisällön mukaan 1-5 toimituksena vuosittain. Toimituskulut on esitetty maksutaulukossa. Kestotilaus on toistaiseksi voimassa oleva sopimus, jonka asiakas voi peruuttaa milloin tahansa ilmoittamalla siitä asiakaspalveluumme. Kerta- ja kestotilauksen lähetyksiä ei ole mahdollista yhdistää. 10. Muut sovellettavat ehdot Tuotekohtaisia ehtoja sovelletaan ensisijaisesti, jos tuotekohtaiset ehdot ja Etäkaupan toimitusehdot ovat keskenään ristiriidassa. Posti on Suomen Asiakkuusmarkkinointiliiton jäsen ja noudattaa liiton käytännesääntöjä. Posti vapautuu sopimuksen mukaisten velvollisuuksien noudattamisesta ja vahingonkorvausvelvollisuudesta force majeure -tapauksissa, joita ovat mm. lakko, työsulku, muu työtaistelutoimenpide, onnettomuudet, viranomaisten toimenpiteet ja muut olosuhteet, joita Posti ei ole voinut välttää ja joiden seurauksia se ei ole voinut estää. Posti pyrkii hoitamaan palvelut mahdollisimman hyvin myös em. poikkeuksellisissa oloissa. Postilla on oikeus tarvittaessa force majeure -tilanteissa priorisoida palvelujen toteuttamista lakisääteisten velvoitteiden, yhteiskunnan toiminnan, terveyden, yleisen turvallisuuden tai muiden vastaavien seikkojen toteuttamiseksi tai turvaamiseksi. 11. Voimassaolo Nämä toimitusehdot ovat voimassa toistaiseksi. Postilla on oikeus muuttaa näitä ehtoja sekä tuoteehtoja. Muutoksesta ilmoitetaan Postin internetsivuilla. 12. Sovellettava laki ja erimielisyydet Tähän sopimukseen sovelletaan Suomen lakia. Mahdolliset erimielisyydet ratkaistaan Helsingin käräjäoikeudessa. Kuluttajalla on oikeus myös nostaa

Scope of application and validity These contract terms apply to distance selling between (hereinafter referred to as Posti ) and a consumer customer (hereinafter referred to as the Customer ), unless otherwise agreed in productor service-specific terms (hereinafter referred to as Product-specific Terms ). Product-specific Terms can be presented when offering a product without having separated them from the product s other description into a separate description. These terms are valid from 13 June 2014 until further notice. 2. Conclusion and transfer of the contract A contract is concluded once Posti has approved an order placed by the Customer. Posti has the right, without the Customer s consent, to transfer the contract in whole or in part to a third party to which the business operations referred to in the contract are transferred. Posti also has the right to transfer its contract receivables to a third party. Posti has the right to cancel the order if the order contains a distinct price error. A distinct price error refers to any typographical error or technical error due to which the price considerably and distinctly deviates from the correct price of the product. The following are examples of a distinct price error. The product s price is 0.00 or it has no price at all The announced price of a collectible item or a gift product is, for example, a few euros. In these cases, the erroneous price deviates from the real price so distinctly that the Customer is deemed to understand it is erroneous. 3. Time and method of delivery The products are primarily shipped within three to five (3 5) business days from the order, unless a different delivery time is specified in the Productspecific Terms. In exceptional situations, the delivery time may be longer, in which case it is indicated in the service. If the order contains stamps or products to be published in the future, these items will be delivered after the publication date and the delivery time will be calculated from the publication date. If the order contains products which are temporarily out of stock, they will be delivered as back orders subject to availability. Due to the aforementioned reasons, the order may be shipped in more than one shipment. Shipping the order in multiple shipments will not impact the shipping costs payable by the Customer. Shipments weighing no more than 2 kg will be shipped as a Priority letter, and shipments weighing more than 2 kg will be shipped as an Economy package, unless otherwise agreed in the Product-specific Terms. 4. Shipping fees Shipping fees depend on the product, total order and country of delivery. If the product has a product-specific shipping fee or if the shipping fee is included in the price, it is indicated in the product information. Otherwise, the shipping fees for domestic shipments are as follows: The value of the order is less than 27: 3 The value of the order is 27 or more: no shipping fees. International shipments: 5. 5. Customer s right of cancellation and returns The Customer has the right to familiarize itself with the product for fourteen (14) days after receipt and return it if it does not meet their expectations. The product being returned must be in the same condition as when it was delivered. The Customer can cancel an order using the Posti cancellation form. Returning goods during the cancellation period is also considered cancellation of the order by Posti. Posti will pay for the return charges of the product in continental Finland when the product is returned during the cancellation period or due to a defect and the return is made as Posti s customer return. When returning goods from the Åland Islands or from abroad or due to reasons other than those mentioned above, the Customer is responsible for the transportation charges of the shipments. 6. Exceptions to the cancellation right Products and services may be covered by a cancellation right which deviates from the previous item or may not be covered by a cancellation right. The exceptions are based on prerequisites stipulated in Chapter 6 of the Consumer Protection Act. An exceptional cancellation right or the lack of a cancellation right is announced in the Product-specific Terms. 7. Reclamations and feedback The Customer should inspect the shipment immediately after receipt. Posti must be notified of any defects within a reasonable time from when the Customer noticed
5 (5) them or from the moment the Customer should have noticed the defect. Posti is responsible for product defects to consumers in accordance with the defect responsibility stipulated in the Consumer Protection Act. Reclamations and inquiries should be made at Posti s customer service, tel. +358 (0)200 71000, asiakaspalvelu@posti.com. 8. Customer register The names and contact details of online store customers are stored in Itella s Consumer customer register. This information is used in the manner described in the file description. The file description can be requested from Posti s Customer service. 11. Validity These delivery terms are valid until further notice. Posti has the right to change these terms and product terms. The changes are announced on Posti s website. 12. Applicable law and disputes This Agreement shall be subject to Finnish law. Possible disputes will be resolved in the District Court of Helsinki. The Customer also has the right to initiate legal proceedings in the court of first instance of their home municipality or bring the matter to the Consumer Disputes Board for processing. 9. Standing order subscriptions New stamps, first day covers and certain stamp products may be ordered on a standing order subscription. Standing order subscriptions will be delivered, according to the content of the order, in 1-5 consignments each year. The delivery charges are given in the payment schedule. A standing order is a contract effective until further notice, which may be cancelled by the customer at any time with a notification to our customer service. It is not possible to combine consignments of single orders and a standing order subscription. 10. Other applicable terms If the Product-specific Terms and the Delivery terms of distance selling are in conflict, the Product-specific Terms take precedence. Posti is a member of the Finnish Direct Marketing Association (Asiakkuusmarkkinointiliitto) and complies with the association s code of conduct. Posti shall be released from compliance with the obligations under the Agreement and its obligation to pay damages in case of force majeure situations, such as strikes, lockouts, other industrial action, accidents, measures by authorities and other circumstances that could not be avoided by Posti and the consequences of which could not be prevented by Posti. Posti will make every effort to deliver its services, even under the above-mentioned exceptional circumstances, as well as possible. In force majeure situations, Posti shall be entitled, if necessary, to prioritize the execution of services in order to implement or ensure statutory obligations, the functioning of society, health, public safety or other similar factors.
