Jatko-opiskelija saa yleiskuvan oikeustieteen eri tutkimussuuntausten metodeista ja ymmärtää oman tutkimuksensa metodologiset lähtökohdat. Oikeustieteellisen tutkimuksen eri metodit. Metodiseminaari suoritetaan osallistumalla seuraaville luennoille ja tekemällä luennoilla annetut harjoitustehtävät: - Rahoituksen hankinta jatko-opintoihin, tutkimuksen laadun arviointikriteerit ja oikeustieteen tutkimusmenetelmät. - Tutkimusetiikka ja hyvä tieteellinen käytäntö. - Laadulliset ja määrälliset tutkimusmenetelmät ja niiden erilaiset käyttötavat oikeustieteellisessä tutkimuksessa. - Tieteellisen kirjoittamisen perusteet. - Oikeudellisen ratkaisun teorian luennot. - Tutkimussuunnitelma- ja artikkelikäsikirjoitusklinikka. Vaihtoehtoisesti voi suorittaa opintojakson 5312111 International Research Methodologies, 5 ECTS. 5312105 J: Yleinen jatko-opintoseminaari 5 op HYV/HYL Jatko-opiskelija harjaantuu tieteellisten alustusten pitämisessä ja seminaarityöskentelyssä sekä omaan tutkimusaiheensa esittelyssä. Tieteellisten alustusten pitäminen, seminaareihin osallistuminen ja väitöstilaisuuksien seuraaminen. Jatko-opintoseminaari suoritetaan 1) osallistumalla kahdesti aktiivisesti oikeustieteiden tohtoriohjelman tutkija- ja jatkokoulutuspäiville ja 2) seuraamalla kahta oikeustieteellisen tai muun alan väitöstilaisuutta jossain suomalaisessa yliopistossa. Oikeustietieteiden tohtoriohjelman tutkija- ja jatkokoulutuspäivät järjestetään joka kevät. Jatko-opiskelija esittää tapahtumassa oman paperin tarkemman ohjeistuksen mukaan. Seuratuista väitöstilaisuuksista laaditaan raportti (yhteensä noin 10 sivua), joka palautetaan vastuuopettajalle. Raportissa tulee kiinnittää huomiota siihen a) millaisia teemoja väitöksessä nostettiin esiin ja b) millaisia teoreettis-metodologisia kysymyksiä väitöksessä käsiteltiin ja miten. Opettaminen oman oikeudenalan kursseilla ja asiantuntijataitojen kehittäminen. Opetustehtävät - Jatko-opiskelija opettaa yliopistotason kursseja. - Suorituksen laajuuden määritteleminen: vähintään 6 h luentoja sisältävän opintojakson opetus 4 op tai opettajavaihto ulkomailla 6 op. - Opetettavista kursseista on sovittava pääaineen professorin kanssa. General transferable skills studies 5312109 Teaching and expert tasks Doctoral students develop as teachers and experts on their own research field. Teaching in courses related to one s own field of law and performing expert tasks. Teaching Doctoral students teach on university-level courses. The number of ECTS awarded for teaching: teaching on a course that contains at least 6 hours of lectures, 4 ECTS; participating on a teacher exchange programme abroad, 6 ECTS. The courses to be taught shall be agreed with the professor of the major subject. It is recommended that teaching takes place towards the end of doctoral studies and that the course topics are related to the student s field of research. Teaching includes preparing the course, giving lectures, grading students exams or other attainments and collecting feedback from the students. To have teaching registered as a study attainment, the doctoral student must present a working certificate (if the teaching took place outside the student s department) or the course structure, a list of grades given and the collected student feedback. Specialist studies Doctoral students are expected to develop their professional skills, including presentation, negotiation, project management and research teamwork skills. The University of Eastern Finland arranges general studies intended for all doctoral students which include several courses where students can develop their professional skills. In addition to university courses which develop students professional skills, work experience serving the same purpose can be included in the studies. In other words, practical, reported work in the field of law, for example, can be accepted as a study attainment as long as it supports the dissertation work. The course exposes post-graduate students to traditional legal research methodologies and their alternatives. It further equips students with tools to identify and structure the theoretical premises and commitments underlying their own research. Finally, the course facilitates early-stage writing and familiarizes students with research ethics. The course is organized as an interactive online seminar where students explore recent theoretical texts, reflect on their own methodological orientations and present brief samples of their methodology sections. Each doctoral student is expected to participate twice during her studies in the Annual Research and Postgraduate Seminar organized by the Law School each spring (May). Students are expected to present their work (a research plan, chapter of the dissertation, an article etc.) at the seminar. Doctoral students residing abroad can compensate this course by twice presenting their papers in other scientific seminars in Finland or abroad. Each student is also expected to attend two public doctoral dissertation defenses (law or other disciplines) and write a five-page report on each of them. In the reports attention should be paid to both methodological and theoretical themes that were addressed in the public defenses by the opponents. This happens by reading extracts from classical natural law
and social contract theorists, as well as modern texts on the foundations of human rights, and discussing the texts together in class. Thus, the course will give the students a chance to practice their argumentative skills in English in addition to familiarizing them with the theoretical background of human rights. Philosophical background of human rights The course will consist of independent studying of texts, discussing them together in class, and writing a final essay. Data collection in the qualitative approach follows a combination of three main methods observations, interviews, and document analysis. It typically starts with the identification of methodology, data collection, analysis, ethical concerns, and adapt to the dynamics if working in a team. The course involves development of practical research skills and theoretical knowledge in the area of qualitative methodology. Belonging to the critical tradition of social sciences, the qualitative methodology also develops general critical thinking of the students. The students participating the course are encouraged to carry out an empirical qualitative research. A student may choose any topic for empirical legal research. The topics will be agreed during introductory part of the course. The results of the research have to be presented in a brief report (12 15 pages). The main requirement for the report is usage of issues discussed in lectures, and demonstration of practical skills of qualitative research.
The course is designed as 24 hours lectures combined with discussions. Each student will write a report on a chosen topic.
