2 KAUPPAPOLITIIKKA TOI PANAMALLE TYÖKALUT PUOLUSTAA VEROPARATIISIRAKENTEITAAN POLITIIKASTAARTIKKELIT, MATTI YLÖNEN, TEPPO ESKELINEN2 Veroparatiisien vastustus nousee koko ajan tärkeämmäksi maailmanpolitiikan kysymykseksi, kun taas kiinnostus kauppapolitiikkaa kohti hiipuu. Kuitenkin juuri kauppa- ja veropolitiikan liitoskohtiin tulisi kiinnittää huomioita, kun tutkitaan veroparatiisien vastaisen politiikan mahdollisuuksia. Veroparatiisit ja verotuksen globaali hallinta yleisemmin ovat 2000-luvulla nousseet merkittäviksi maailmanpolitiikan kysymyksiksi. Esimerkiksi EU:ssa on ollut viime kuukausina käsittelyssä useita aloitteita, jotka liittyvät veroparatiisitalouden ja kansainvälisen veropaon hallintaan. Myös Taloudellisen yhteistyön ja kehityksen järjestön OECD:n aloitteet yritysverotuksen kehittämiseksi ovat keränneet huomiota. Samaan aikaan kiinnostus kauppapolitiikkaa kohtaan on aivan viime vuosia lukuun ottamatta laskenut. Kuitenkin juuri kauppa- ja veropolitiikan liitoskohtiin tulisi
3 kiinnittää huomioita, kun tutkitaan veroparatiisien vastaisen politiikan mahdollisuuksia. Juuri kauppa- ja veropolitiikan liitoskohtiin tulisi kiinnittää huomioita, kun tutkitaan veroparatiisien vastaisen politiikan mahdollisuuksia. Globaalin talouden hallinnassa ei ole kyse vain irrallisten politiikkaohjelmien toteuttamisesta, vaan suuri merkitys on sillä, mikä painoarvo eri politiikkalohkoille annetaan toisiinsa verrattuna. Kauppapolitiikkaa on viime vuosikymmeninä tarkasteltu tyypillisesti suhteessa siihen, miten kauppasopimukset lukitsevat politiikan asialistaa ja liikkumavaraa. Veroparatiiseja on puolestaan lähestytty suvereniteetin kaupallistumisen kautta. Näiden ilmiöiden yhteydet toisiinsa ovat kuitenkin jääneet katveeseen. Havainnollistamme tässä asiaa viime aikojen mielenkiintoisimman tapauksen, veroparatiisi Panaman kauppapoliittisen toiminnan kautta. Veroparatiisi on aktiivinen toimija Keväällä 2016 käynnistynyt niin sanottujen Panaman paperien tietovuoto Mossack Fonseca -asianajotoimistosta nosti pienen Keski-Amerikan valtion otsikoihin ympäri maailmaa. Tuntemattomaksi jääneen yksityishenkilön vuotamat 11,5 miljoonaa dokumenttia paljastivat Nordean ja muiden pankkien myymien veroparatiisipalvelujen laajuuden ja kansainvälisen veronkierron arjen. Veroparatiisipalvelujen kauppa on tapahtunut Panaman valtion aktiivisella tuella. Valtio ei siis ole ainoastaan hiljaa sallinut näitä toimintoja, vaan aktiivisesti muokannut lainsäädäntöään kysynnän mukaan houkutellakseen veroparatiisitalouden toimijoita. Lisäksi Panama pyrkii aktiivisesti suojelemaan asemaansa veroparatiisina, mikä on ollut uhattuna viime aikoina, kun veroparatiisitalouden globaalit haittavaikutukset ovat aktivoineet yhä useampia valtioita kansainväliseen yhteistyöhön asiassa. Veroparatiisipalvelujen kauppa on tapahtunut Panaman valtion aktiivisella tuella. Panama on aiemminkin ollut kokoaan suurempi toimija kansainvälisessä poliittisessa taloudessa. Tämän vuosituhannen alussa OECD esitti sanktioita veroparatiiseille ja niihin meneville rahavirroille. Tutkija Jason Sharman on kuvannut, kuinka Panama liittoutui Karibian alueen pienten veroparatiisien sekä Yhdysvaltojen uuskonservatiivisten ajatushautomojen kanssa ja käänsi vasta valitun George W. Bushin hallinnon vastustamaan OECD:n aloitteita.
4 Tätäkin kiinnostavampaa on Panaman viimeaikainen toiminta Maailman kauppajärjestössä WTO:ssa. WTO on toiminut Panamalle välineenä, jonka avulla se on suojautunut kansainväliseltä veropolitiikalta. Panaman toimien foorumina on toiminut WTO:n riitojenratkaisuelin. Se antaa tämän maailmanjärjestön jäsenille mahdollisuuden haastaa toisiaan oikeuteen WTO:n alaisten kauppasopimusten rikkomisesta. Riitojenratkaisuelimen päätöksiin ei liity suoranaisia sanktioita, mutta käytännössä sen pelotevaikutus on ollut vahva. Rahanpesun estämisestä tuli kauppapolitiikkaa Muutama vuosi sitten Kolumbia yritti saada kuriin Panamasta tulevaan tuontiin liittyvää rahanpesua, salakuljetusta ja virheellisiä tullaushintoja. Erityisesti Panaman vapaatuotantoalue Colon on kansainvälisesti tunnettu ongelmaalue, jota käytetään kolumbialaisen huumerahan pesuun. Virallisissa tilastoissa Panaman vienti Kolumbiaan oli kolminkertainen suhteessa Kolumbian tuontiin Panamasta. Panama sivuutti vuosina yli 99 prosenttia Kolumbian tietopyynnöistä. Niinpä Kolumbia siirtyi käyttämään panamalaisten tavaroiden tullauksessa salakuljetusta hillitseviä viitehintoja. Muutama vuosi sitten Kolumbia yritti saada kuriin Panamasta tulevaan tuontiin liittyvää rahanpesua, salakuljetusta ja virheellisiä tullaushintoja. Tuonti Panamasta ohjattiin kahdelle tulliasemalle, joiden henkilökunta oli erikoistunut väärinkäytösten torjuntaan, ja jolle annettiin lisäkoulutusta. Tulliasemien toiminnan joustavuudesta huolehdittiin, jotta toimet eivät häiritsisi kaupankäyntiä. Tästä huolimatta Panama syytti Kolumbiaa tullaussopimuksen rikkomisesta ja syrjinnästä. WTO:n riitojenratkaisupaneelin päätöksessä ymmärrettiin Kolumbian tarve torjua rahanpesua. Kolumbian toimia ei myöskään pidetty kauppaa häiritsevinä. Silti paneeli ratkaisi asian Panaman eduksi vedoten toimien panamalaisille tuotteille aiheuttamaan ylimääräiseen haittaan. Kolumbia ei saanut edes toivomaansa siirtymäaikaa lainsäädännön muuttamiseen ja tullihenkilökunnan kouluttamiseen. Panama hyökkäsi myös Argentiinaa vastaan Argentiina pyrki vuonna 2011 ottamaan käyttöön sanktioita maille, jotka kieltäytyivät verotietojen vaihtosopimuksen solmimisesta tai aloittamasta tällaisen sopimuksen solmimiseen tähtääviä neuvotteluja. Sanktiot perustuivat OECD:n suosituksiin ja olivat näin täysin kansainvälisen veroagendan mukaisia. Panama oli yksi näistä maista.
5 Panama riitautti tämänkin tapauksen WTO:ssa vetoamalla palvelukauppasopimuksen (GATS, General Agreement on Trade in Services) pykäliin. Kyseessä olleiden pykälien mukaan kotimaisia palveluita ja palvelun tarjoajia ei saa suosia, vaan ne pitää asettaa samalle viivalle muista maista tulevan tuonnin kanssa. Veroparatiisi Panaman mukaan sanktiot asettivat panamalaiset pankit alkuperän perusteella eriarvoiseen asemaan, mikä rikkoi GATS-sopimusta. Myös tämä kiista ratkesi pääosin Panaman hyväksi. WTO:n riitojenratkaisupaneeli korosti palveluiden samankaltaisuutta ja tulkintaa, jonka mukaan palvelut ovat samankaltaisia, jos ne ovat keskenään kilpailuasetelmassa. Paneeli piti samankaltaisten palveluiden tai palveluntarjoajien yhtäläistä kohtelua tärkeämpänä kuin kansainvälisiä yrityksiä torjua veronkiertoa. Vetoomuspaneeli muutti myöhemmin päätöstä, mutta Argentiina oli jo vetänyt toimiaan takaisin. Lukitut politiikan välineet Edellä kuvatut ovat periaatteessa yksittäisiä kauppakiistoja, mutta osoittavat havainnollisesti kauppapolitiikan roolin globaalien vero-aloitteiden läpiviemisessä. Veroparatiisit voivat käyttää kauppasopimuksia estääkseen veronkierron torjuntaa, vaikka tarpeesta ratkaista veroparatiisiongelma sitovin säännöin ollaan yksimielisempiä kuin koskaan. On huomionarvoista, että sekä Argentiinan että Kolumbian toiminta oli linjassa meneillään olleiden kansainvälisten veroaloitteiden kanssa. Veronkierto ja verojen välttely olivat nousemassa merkittäviksi kansainvälisiksi teemoiksi samaan aikaan näiden kauppariitojen kanssa. Veronkierto ja verojen välttely ovat laajoja ongelmia, joiden torjunta ei onnistu yksin verolakeja viilaamalla. Vaikka veropolitiikassa on saavutettu suuria konsensuksia ja paljon edistystä, veropoliittiset toimet jäävät puutteellisiksi ellei niihin liity muiden politiikkalohkojen harmonisointi. Valtavirran kriittinen globalisaatioteoria on nähnyt kansallisvaltioiden edustavan demokraattista ohjausta, jota ylikansallinen kurinalaistava uusliberalismi uhkaa. Näin usein onkin, mutta Panaman tapaukset monimutkaistavat tätä kertomusta useilla eri tavoilla. Ensinnäkin Panama on kansallisvaltio, joka toimii ylikansallista agendaa vastaan, mutta käytännössä sen vero- ja salaisuuslait eivät edusta sen kansalaisten etuja vaan ilmiötä, jota kutsutaan kaupallistetuksi suvereniteetiksi. Sillä tarkoitetaan
6 kehityskulkua, jossa veroparatiisivaltiot räätälöivät lakejaan tarjotakseen kyseenalaisia etuja kansainvälisille sijoittajille ja yrityksille. Toiseksi kauppasopimukset ovat usein ongelmallisia, mutta tässä tapauksessa eivät sen takia, että ne suoraan lukitsisivat politiikan sisältöä. Pikemmin ne lukitsevat politiikan välineitä : kauppasopimukset tarjoavat huomattavaa poliittista valtaa, jota voidaan käyttää eri tavoin. Kauppasopimukset lukitsevat politiikan välineitä. Panama on hyödyntänyt WTO:n riitojenratkaisumekanismia voittopuolisesti veroparatiisilainsäädäntönsä puolustamiseen. Toisaalta samoja kauppapolitiikan työkaluja voitaisiin periaatteessa käyttää myös estämään verojen välttelyä. EU:n nostamat oikeusjutut Luxemburgin ja Irlannin kyseenalaisia veroetuja vastaan ovat esimerkkejä tästä. Kolmanneksi ylikansallisen politiikan agenda ei tässä tapauksessa ole yksimielinen vaan sisäisesti ristiriitainen. Poliittisesti ratkaisevat valtasuhteet eivät näin ollen ole ylikansallisen ja kansallisen politiikan vaan eri ylikansallisten politiikkalohkojen välisiä. Vero- ja kauppapolitiikan poliittisia yhteentörmäyksiä ei voi välttää. Olennaista on, kumman (tai minkä) agendan ehdoilla se toteutuu. Sama pätee myös moniin muihin ylikansallisen politiikan lohkoihin. Ilman monipuolista tutkimustietoa myös globaalin talouden hallinta ontuu Kansainvälinen veropolitiikka on tällä hetkellä nopeassa murroksessa. Aloitteet erilaisten sijoitustuotteiden verotietojen vaihdosta ovat edenneet nopeasti. Myös monikansallisten yritysten verotuksessa ja sen läpinäkyvyydessä on otettu edistysaskelia, vaikka ne ovatkin jääneet osin puolitiehen. Tarvitaan kuitenkin lisää herkkyyttä havaita eri aloitteiden vaikutuksia toisiinsa. Panaman tapauksessa on selvää, että palvelukaupan sopimusten neuvottelijoiden oli mahdoton ennakoida, että sopimusta käytettäisiin suojaamaan veronkiertopalveluita. Ilmiö korostuu kauppasopimusten alan laajentuessa jatkuvasti alkuperäisistä tullausmaksuista ja -säännöksistä kohti yleispolitiikkaa. Kauppasopimukset tyypillisesti vaikeuttavat monenlaista poliittista ohjausta. Sopimuksiin kirjoitetut poikkeukset ovat luettelomaisia ja sopivat huonosti tulevaisuuden politiikan ennakointiin. Kukaan ei osaa ennustaa, minkälaisia päätöksiä nykyiset kauppasopimukset estävät tulevaisuudessa. Kansainvälisessä politiikassa kuitenkin tarvitaan tilaa toteuttaa uutta sääntelyä ja sopimuksia monella alueella. Politiikan lukitseminen on vaarallista.
7 Panaman tapaus osoittaa kuitenkin myös, että veroparatiisien vastainen politiikka ei jäsenny yksioikoisesti kurinalaistavan uusliberalismin muottiin. Kansallisen suvereniteetin suojeleminen ei automaattisesti johda demokraattisimpaan lopputulokseen. Maailmanpoliittista painoarvoaan pienemmät valtiot tai ryhmät voivat käytännössä ohjata globaalia politiikkaa, kuten Panaman tapaus osoittaa. Asiantuntijatiedon merkitys korostuu, kun kauppapolitiikka muovaa välineitä, joilla veropolitiikkaan voidaan vaikuttaa. Maailmanpoliittista painoarvoaan pienemmät valtiot tai ryhmät voivat käytännössä ohjata globaalia politiikkaa, kuten Panaman tapaus osoittaa. Tämä puolestaan korostaa monimuotoisen tutkimustiedon merkitystä. Vero- ja kauppapolitiikan parhaiten palkatut työpaikat ovat tyypillisesti alan veroneuvonta- ja asianajotoimistoissa. Globaalin talouden toimiva demokraattinen hallinta edellyttää myös sitä, että yliopistoilla ja esimerkiksi YK:n kaltaisilla kansainvälisillä järjestöillä on riittävät resurssit tuottaa vaihtoehtoisia esityksiä ja analyysejä.
