5 HUUTOKAPPAEHDOT 1. Huutokauppa on julkinen, vapaaehtoinen ja se tapahtuu toimeksiantajan (kohteiden jättäjän) lukuun sekä Philean nimissä. Luettelossa olevat hinnat ovat lähtöhintoja, jonka alle ei oteta vastaan tarjouksia. Philea käyttää ns. voitto-marginaali- systeemiä, eli välityspalkkioon sisältyy arvonlisävero. 2. Kohteet myydään eniten tarjoavalle, kuitenkin niin, että aloitushinta on sama kuin internet- sivuillamme näkyvä, toiseksi korkein tarjous + yksi korotus. Kohde myydään lähtöhinnalla, jos on vain yksi tarjous. Jos on kaksi yhtä suurta tarjousta, ensiksi tullut voittaa. 3. Huutokaupan meklari korottaa hintoja seuraavasti: EUR korotukset ovat 5 EUR EUR korotukset ovat 10 EUR EUR korotukset ovat 50 EUR EUR korotukset ovat 100 EUR 5001 EUR - ja yli korotukset ovat noin 5 % Meklari voi poiketa yo. kiinteistä korotuksista. 4. Auktionären har också rätt att ej antaga bud utan att ange skäl därför. 6. Vid postbefordran tillkommer porto. Likvid skall erläggas inom 14 dagar från fakturadatum. Vid senare betalning debiteras ränta med 2 % per månad samt kravavgift EUR 3. Äganderätten till inropat objekt övergår inte på köparen förrän full likvid inkl. provisioner och kostnader erlagts. Det åligger anbudsgivaren att själv kontrollera om anbud lett till köp 7. Anbud är bindande och innebär godkännande av auktions vill koren. Vid bud för annan svarar bud givaren för att auktions vill koren följs som för eget bud. AUCTION CONDITIONS 1. The auction is public and volontary and is conducted in the name of AB Philea on behalf of its vendors. The listed starting prices are minimum prices, underbids are not accepted. AB Philea uses the Margin scheme (also known as the Global System ) meaning that no VAT will be specified on invoices. 2. The lot shall be sold to the person making the highest bid at a sum equal to the next highest bid plus one fixed increase. If there is only one bid the lot will be sold for the starting price. In the event of two identical bids the first bid received takes priority. 3. At the auction the following fixed increases are applied: EUR increase 5 EUR increase 10 EUR increase 50 EUR increase 100 Above EUR 5000 increase approx. 5% At the auctioneer s discretion these fixed bid steps may not be used. 4. A commission of 25 % is added to the hammer price for each lot, both to domestic and foreign customers. 5. The auctioneer has the right to re-open bidding if there has been any misunderstanding. The auctioneer reserves the right to reject persons from the auction or decline bids without giving any reason for doing so. 6. If lots need to be sent by postal or courier services, the cost of this service will be added to any invoice. Payment for lots purchased by a bid at the auction shall be made in cash, or against a pro forma invoice. The lots remains the property of the vendors until such time as full payment is made. Payment shall be received within 14 days of the date of invoice. In the event of delay in payment interest is charged at 2 % of the invoiced sum for each month commenced plus a reminder fee of EUR 3. It is the responsibility of the buyer to check if a bid has lead to a purchase. 7. Tarjoaminen on sitova ja tarjouksen tekijä hyväksyy samalla nämä huutokauppaehdot. Tehdyistä tarjouksista vastaa huudon tehnyt henkilö myös toimiessaan toisen henkilön puolesta. 8. Mikäli maksua ei ole suoritettu 30 päivän kuluessa, Philealla on oikeus peruuttaa ostotarjous ja silloin Philealla on oikeus saada korvaus menetetystä myyjän ja ostajan välityspalkkiosta. Philealla on oikeus ilman eri ilmoitusta huutokaupata maksamaton kohde uudelleen, tarjouksen tehneen ostajan kustannuksella. 9. Yksittäiseen kohteeseen tehtävät mahdolliset huomautukset on tehtävä viikon kuluessa siitä, kun kohde on toimitettu, jos muuta ei ole sovittu. Huomautus voidaan hyväksyä, jos kohde poikkeaa huutokauppaluettelon kuvauksesta ja virhe ei ole vähäinen. Kokoelmista ja eristä tehdyt huomautukset hyväksytään ainoastaan, jos kohteet olennaisesti poikkeavat huutokauppaluettelon kuvauksesta. Huutokaupan pitäjän omat kommentit kohteen loistokunnosta tai loistolaadusta ovat henkilökohtaisia arvioita kohteista, eivätkä siten sinänsä ole peruste palautukseen. Huutokaupassa noudatetaan yksinomaan ruotsalaista oikeuskäytäntöä ja Ruotsin lakia. Siinäkin tapauksessa, että käännösteksteissä Ruotsin kielestä suomeksi tai englanniksi on ristiriitaisuuksia, noudatetaan ruotsinkielistä tekstiä. 8. Om likvid ej erlagts inom 30 dagar äger auktionären rätt att häva köpet, varvid auktionären äger rätt att erhålla ersättning för utebliven säljar- och köpar provision. Auktionären äger att utan vidare meddelande sälja ej betalda objekt på ny auktion på köparens bekostnad. 9. Reklamation av objekt skall meddelas auktionären inom en vecka efter leverans om inget annat avtalas. Reklamation godtages om objektet avviker från beskrivningen i auktionskatalogen och felet ej är av ringa betydelse. Reklamationer av samlingar och partier beaktas om objektet väsentligt avviker från katalogbeskrivningen. Kommentarer om prakt- och lyxkvalitet är våra personliga omdömen om objekt och utgör i sig inte grund för retur. Vid tvist gäller svensk lag. Bids are binding and in placing a bid the customer accepts the auction conditions. In the event of bids being presented by persons on behalf of another person; the person presenting the bid is liable to satisfy the auction conditions as if it were his own bid. The person presenting the bid is also responsible for errors made by him in when acting as agent at the auction. Similarly, the person presenting the bid is liable for any errors or misunderstandings in the case of unconfirmed bids by telephone or telegraph. 8. If full payment has not been received by us within, at the latest, 30 days after the date of invoice or if the purchaser refuses to pay, we are entitled to sell the lot at the purchaser s expense with out giving any further notice. If this occurs the sum received on sale, after deduction of sales expenses, will be deducted from the unpaid debt. Any sum remaining due will be sub sequently recovered by legal measures. 9. Lots are sold in their present condition except where other remarks concerning their quality have been made in the catalogue or on Internet. This means, among other things, that defects not visible in photographs or deviations from descriptions of quality of individual articles/sets are not regarded as defects. For collections and accumulations tradesmen are not entitled to make any claims and private consumers rights are limited to those stipulated in Section 9 of the Swedish Consumers Sales Act. Purchaser discovered or ought to have discovered the defect, normally within one week following the purchaser s receipt of the lot or his having had such opportunity following notification by his post office of the lot s arrival. If a complaint is approved the price of the lot will be repaid to the purchaser plus any postage. The auctioneer may in the event of a complaint request a certificate from an impartial well-known expert. Lots with certified authenticity may, if the auctioneer considers it appropriate, only be returned if at least two impartial and well-known experts have an opinion which varies with that of the person who certified the authenticity. The auction is conducted and sales made are subject to the exclusive jurisdiction of the Swedish courts and is subject to Swedish law. In the event of any discrepancies in the text arising from translation, the Swedish text shall prevail. 5

19 ) The first Finnish olympic gold medallist was Verner Weckman (born , died ) in the Olympic games in Athens Weckman also won gold medal in wrestling in the London Olympic games in This lot contains a number of items focusing on Weckman: 1) A cm painting of the olympic wrestler Weckman, made by the painter E. Selin (born , died ). 2) A unique 38 cm tall bronze statuette Lifting power, a powerful young athlete lifting the earth with cables, made by sculptor Matti Haupt with Weckman as model. On Weckman s 80th birthday in 1962, the personnel of Finnish Cable Works company in Helsinki where Verner Weckman, Mining Counselor, was the executive director from 1937 to 1955 gave the statuette as a gift to him. There is fixed a silver plate from this on the pedestal of the statuette. The full-size statue Lifting Power ( Kohottava voima ), is situated in Telakanpuistikko, Punavuori, Helsinki. 3) Three articles written in first person: Memories of my youth, Wrestling in Athens 1906 and London Olympic games Additionally a page from Wikipedia. 4) The lot also includes a booklet, with the original signatures of some directors of the Cable Works company, among others Lauri Kivekäs and O.
