Tekijänoikeuden uudistusprosessi 1996-
Tekijänoikeus ja sisältö Kopiointi, levitys ja muuntelu on voimassaolevan lain mukaan kiellettyä ellei siihen saatu erikseen lupaa (lisenssiä) Käytännössä teosten käyttö on kiellettyä, jos käyttö edellyttää kopiointia Laissa kuitenkin laajat käyttäjän oikeudet (yksityiskopiointi, sitaatti, opetus jne.)
Uudistusprosessin alku World Intellectual Property Organization (WIPO): Copyright Treaty, 1996 Artikla 5: Compilations of Data (Databases) Compilations of data or other material, in any form, which by reason of the selection or arrangement of their contents constitute intellectual creations, are protected as such. Artikla 6: Right of Distribution... Nothing in this Treaty shall affect the freedom of Contracting Parties to determine the conditions, if any, under which the exhaustion of the right... applies after the first sale or other transfer of ownership of the original or a copy of the work with the authorization of the author Artikla 11: Obligations concerning Technological Measures Contracting Parties shall provide adequate legal protection and effective legal remedies against the circumvention of effective technological measures that are used by authors in connection with the exercise of their rights under this Treaty or the Berne Convention and that restrict acts, in respect of their works, which are not authorized by the authors concerned or permitted by law.

The answer is a clear no. In the United States, the database industry has grown more than 25-fold since 1979 and - contrary to those who paint the Feist case as a revolution - for that entire period, in most of the United States, it was clear that unoriginal databases were not covered by copyright. The figures are even more interesting in the legal database market. The two major proponents of database protection in the United States are Reed Elsevier, the owner of Lexis, and Thomson Publishing, the owner of Westlaw. Fascinatingly, both companies made their key acquisitions in the US legal database market after the Feist decision, at which point no one could have thought unoriginal databases were copyrightable. This seems to be some evidence that they believe they could make money even without a database right. How? In the old-fashioned way: competing on features, accuracy, tied services, making users pay for entry to the database and so on.
Tekijänoikeusdir (2001) 1/2 Article 6 Obligations as to technological measures 1. Member States shall provide adequate legal protection against the circumvention of any effective technological measures, which the person concerned carries out in the knowledge, or with reasonable grounds to know, that he or she is pursuing that objective. 2. Member States shall provide adequate legal protection against the manufacture, import, distribution, sale, rental, advertisement for sale or rental, or possession for commercial purposes of devices, products or components or the provision of services which: (a) are promoted, advertised or marketed for the purpose of circumvention of, or (b) have only a limited commercially significant purpose or use other than to circumvent, or (c) are primarily designed, produced, adapted or performed for the purpose of enabling or facilitating the circumvention of, any effective technological measures. 3. For the purposes of this Directive, the expression 'technological measures' means any technology, device or component that, in the normal course of its operation, is designed to prevent or restrict acts, in respect of works or other subject-matter, which are not authorised by the rightholder of any copyright or any right related to copyright as provided for by law... Technological measures shall be deemed 'effective' where the use of a protected work or other subject-matter is controlled by the rightholders through application of an access control or protection process, such as encryption, scrambling or other transformation of the work or other subject-matter or a copy control mechanism, which achieves the protection objective.

Notwithstanding the legal protection... in the absence of voluntary measures taken by rightholders, including agreements between rightholders and other parties concerned, Member States shall take appropriate measures to ensure that rightholders make available to the beneficiary of an exception or limitation provided for in national law... the means of benefiting from that exception or limitation... where that beneficiary has legal access to the protected work or subject-matter concerned. The provisions of the first... subparagraphs shall not apply to works or other subject-matter made available to the public on agreed contractual terms in such a way that members of the public may access them from a place and at a time individually chosen by them. Saako kiertää?
Vastaus Kaikki käyttörajoitukset saa kiertää, koska teos ei ole tekijänoikeuden alla (ellei ole uutta kuvitusta tms. merkittävästi omaperäistä lisätty, jolloin sivujen printtaus voisi olla tekijänoikeudellisesti relevanttia kopiointia)

Vastaus Saa jos käyttäjän oikeudet sitaattiin (copy selection to clipboard) ja yksityiseen kopiointiin (print a page) menevät käyttörajoitusten edelle Direktiiviä kirjaimellisesti lukien näyttäisi olevan kiellettyä eli ei saa kiertää Ääneen lukemisen rajoituksen saa sen sijaan epäilemättä kiertää, koska se ei loukkaa tekijän yksinoikeuksia (ellei lueta ääneen radiossa)

It's not surprising that clever businessmen find ways to use their control to put you at a disadvantage. "Trusted computing" would make it pervasive. Some of us might even prefer to use a positive term such as "sharing information with your neighbor." "Digital Rights Management" software is actually designed to impose restrictions on computer users. The use of the word "rights" in this term is propaganda, designed to lead you unawares into seeing the issue from the viewpoint of the few that impose the restrictions, while ignoring that of the many on whom the restrictions are imposed. Linkkaus ja vertaisverkot
Linkkaus voi olla kiellettyä Norjan korkein oikeus 27.1.2005: suorat mp3- tiedostolinkit webbisivulla napster.no = yleisön saataville saattamista tekijänoikeuslain mielessä; hyvitystä 180 linkistä yhteensä 100 00 kruunua (vaatimus oli 500 000) Samoin Ruotsin korkein oikeus 15.6.2000: mp3- linkkisivu oli offentlig framförande... mutta tässä tapauksessa Ruotsin laki ei johtanut rikosoikeudelliseen seuraamukseen (jota asiassa oli vaadittu, korvauksista ei ollut kysymys)
Soveltuvuus... BitTorrent? Ylipäänsä P2P-palvelut? Napster todettiin aiemmin laittomaksi USA:ssa, sen sijaan Fastrackkiin pohjautuvat palvelut toistaiseksi laillisia mm. USA:ssa ja Hollannissa - käyttäjät rikkovat lakia, palvelu/välittäjä ei Kohtuullisen hyvityksen arviointi: onko autolaina kohtuullinen seuraamus tiedostojen linkityksestä?

Abandonware (vrt. tekijänoikeuden kesto) But is it really illegal? Ask any software professional if software piracy is illegal, and they ll emphatically answer yes. But ask that same professional if copying old software -- say, over 15 years old -- is illegal, and you ll get puzzled faces and mixed answers in return. Most people simply don t know. Once software becomes useless and obsolete, is it still illegal to copy it?

Vest has announced that the Massachusetts Institute of Technology will make the materials for nearly all its courses freely available on the Internet over the next ten years... OpenCourseWare looks counter-intuitive in a market driven world. It goes against the grain of current material values. But it really is consistent with what I believe is the best about MIT. It is innovative. It expresses our belief in the way education can be advanced -- by constantly widening access to information and by inspiring others to participate, said President Vest... Am I worried that the OpenCourseWare project will hurt MIT s enrollment? No. In fact... showing what we teach, may be a very good thing for attracting prospective students... How will OpenCourseWare relate to revenue-generating educational projects at MIT?... I want to emphasize there is no commercially available MIT degree... This is about something bigger than MIT... Mitä tapahtuu seuraavaksi? Kaupalliset intressit vai avoin yhteiskunta? Demokratia tulee esiin vasta kansallisella tasolla vrt. WIPO, WTO, EU ym. byrokratiat, joissa Suomenkin lait nykyään luodaan Lakien perustuslaillinen ( poliittinen ) tulkinta ollut varovaista; taloudelliset argumentit ja kilpailuoikeusnäkökulma voi tuoda tasapainoa yksinoikeuksiin Eettiset arvot vai lain kirjain?
