Miksi?
Yrittäjälle kuuluu oikeus päättää, mihin käyttöön hän myy ja vuokraa omia tuotteitaan. Samaa sisältöä on teknisesti mahdollista tarjota eri hintaan kerta- tai rajoittamattomaan käyttöön, tietyksi ajaksi ja ehkä myös suppeammassa ja laajemmassa laitevalikoimassa toimivaksi... teknisten suojausten purkamisen salliminen luo edellytykset kontrolloimattomien jälkimarkkinoiden syntymiselle, jota teknisillä suojauksilla juuri pyritään estämään. It's not surprising that clever businessmen find ways to use their control to put you at a disadvantage. "Trusted computing" would make it pervasive. "Treacherous computing" is a more appropriate name, because the plan is designed to make sure your computer will systematically disobey you. In fact, it is designed to stop your computer from functioning as a general-purpose computer. Every operation may require explicit permission. Publishers often refer to prohibited copying as "piracy." In this way, they imply that illegal copying is ethically equivalent to attacking ships on the high seas, kidnapping and murdering the people on them. If you don't believe that illegal copying is just like kidnapping and murder, you might prefer not to use the word "piracy" to describe it. Neutral terms such as "prohibited copying" or "unauthorized copying" are available for use instead. Some of us might even prefer to use a positive term such as "sharing information with your neighbor." "Digital Rights Management" software is actually designed to impose restrictions on computer users. The use of the word "rights" in this term is propaganda, designed to lead you unawares into seeing the issue from the viewpoint of the few that impose the restrictions, while ignoring that of the many on whom the restrictions are imposed. P2P - kuka vastaa?

Entä pelkkä linkki? Jos verkkosivulle tuodaan suojattua aineistoa ulkopuolelta linkkien avulla siten, että aineistosta valmistetaan kappale linkittäjän sivun osaksi, tapahtuu tekijänoikeudellisesti merkityksellistä kappaleen valmistamista ja/ tai yleisön saataviin saattamista. Tällaiseen linkittämiseen olisi hankittava oikeudenhaltijan lupa. (Tekijänoikeuslain muutoksen perustelut; HE 28/2004)
Mutta ei kai hakukoneet..? Hakukoneen toiminta näyttäisi nimittäin merkitsevän laajamittaista ja jatkuvaa tekijänoikeuslain rikkomista... Tällöin sääntely muodostuisi perustuslain 12 :ssä turvatun sananvapauden näkökulmasta merkitykselliseksi tietoverkkojen käyttörajoitukseksi. (Perustuslakivaliokunta HE 28/2004:stä)
Toisaalta... Downloadaajalla ei välttämättä vastuuta Vastoin lakia tapahtuvasta teoksen kappaleen valmistamisesta yksityistä käyttöä varten on hyvitysvelvollisuus vain siinä tapauksessa, että kappaleen valmistaja on tiennyt tai hänen olisi pitänyt tietää, että kopioitava aineisto on saatettu yleisön saataviin vastoin tätä lakia. (Tekijänoikeuslaki 57 )
Ja tämäkin vielä... Uploadaajakin vastuussa vain, jos jakaminen tapahtuu avoimelle käyttäjäpiirille Itä-Suomen hovioikeus ( Drink or Die ): ohjelmien jakaminen palvelimella, jossa oli korkeintaan pari-kolmekymmentä tarkoin valittua ja ennalta tunnettua käyttäjää, ei täyttänyt tekijänoikeudellisesti relevantin levittämisen määritelmää

TiVo users want access to the free software components for all sorts of reasons. They want to install bigger hard drives. They want to access their shows via other devices (for instance, copy small versions to portable video devices to take them on the road). DRM on ok GPLv3:n kanssa, kunhan softaa voi edelleen muuttaa vapaasti ja teknisesti suojattu elokuva näkyy siitä huolimatta Tivo-killer Linus Torvalds: I licensed my project under a license _I_ agreed with, which is the GPLv2.
