1 Intrductin The epsiplus Natinal meeting 1 fr Finland was held n the 2 nd Octber 2007 in Tampere, Finland. The meeting titled - Business with Public Infrmatin was a seminar within the MINDTREK 2 2007 Cnference titled - Back t the Future. The agenda fr the meeting appears within Annex 1 f this dcument. DIAGRAM 1 Sectrial analysis f the Delegates 2 Legal and regulatry prgress and impact The Ministry f Finance n the 1 st July 2005 published a press release number 80/2005 titled - Sumen lainsäädäntö vastaa EU:n julkisen sektrin tiedn direktiiviä 5 (Finland's legislatin is in line with the EU's public sectr infrmatin Directive). Finland s revised Cnstitutin that came int effect n the 1 st March 2000 includes the fundamental rights f access t public sectr infrmatin (with exceptins), gd public administratin and fair treatment by public authrities. Representatives frm the Ministry f Finance and the Ministry f Trade and Industry attend the Eurpean Cmmissin s Public Sectr Infrmatin Grup meetings that take place in Luxemburg. Hwever the Ministry f Trade and Industry was clsed dwn n the 31 st December 2007 and a number f its respnsibilities have been transferred t the Ministry f Emplyment and the Ecnmy that came int effect n the 1 st January 2008. 2.1 Transpsitin status The Gvernment f Finland has chsen t implement Directive 2003/98/EC (Direktiivi 2003/98/EY) by amending Law number 621/1999 6 Laki viranmaisten timinnan julkisuudesta (Act n the Openness f Gvernment Activities). Law 495/2005 7 amends Law number 621/1999 partly t cmply with Directive 2003/98/EC. Law 495/2005 was published n 23 rd June 2005 and came int effect n the 1 st Octber 2005. The Law is fficially available in Finnish and Swedish and an unfficial English translatin is als available. 8 At the current time neither Law 161/1999 cnslidated nr Law 495/2005 make any reference t the Eurpean Unin Directive 2003/98/EC as required by the Article 12 f the Directive. Law 621/1999 applies t a wider range f public sectr bdies than Directive 2003/98/EC. 10 Law 1144/1991 as amended Självstyrelselag för Åland (The Act n the Autnmy f Åland) has als been amended t include Directive 2003/98/EC. Finland transpsed Directive 2003/4/EC Access t envirnmental infrmatin via the Act n the Openness f Gvernment Activities. The abve laws cmply with Act 523/1999 11 as amended The Persnal Data Prtectin Act. Law 831/1994 and subsequent amendments set ut the framewrk fr archiving f public sectr infrmatin The Archives Act (831/1994). Law 150/1992 The State Cst Assessment Act as amended sets ut the framewrk fr charging fr public sectr prducts and services. A summary f the transpsitin prcess was published in the Natinal Bradband Strategy Final Reprt n page 53 12. Under the Natinal Bradband Strategy, it was principally the task f the Ministry f Finance t ensure equitable terms fr the cmmercial explitatin f public-sectr infrmatin. Directive 2003/98/EC f the Eurpean Parliament and f the Cuncil n the re-use f public sectr infrmatin entered int frce n December 31, 2003 and was t be implemented in natinal law by July 1, 2005. The wrking grup preparing the matter came t the cnclusin that existing natinal legislatin in Finland, specifically the Act n the Openness f Gvernment Activities (612/1999) and the Act n Criteria fr Charges Payable t the State (150/1992) as amended, cnfrm t the requirements and bligatins f the abve-mentined Directive. The amendment f the Act n the Openness f Gvernment Activities that entered int frce in Octber 2005 (495/2005) clarified the prvisins n the disclsure f dcuments and the fees that may be charged fr infrmatin in certain cases. 2.1.1 Cmplaints prcedure N special arrangements have been put in place fr the handling f cmplaints specifically related t the re-use f public sectr infrmatin. The cmplaints prcess is based upn the framewrk as set ut in Law 586/1996 as amended - The Act n Administrative Judicial Prcedure. The cmplainant must first ldge the cmplaint with the pertinent public bdy (r its agent) that hlds the infrmatin required. The appeal prcess is then via the Supreme Administrative Curt r in the cases related t an appeal against the decisin f a lcal r reginal authrity and a decisin f an institutin, crpratin, fundatin r private individual exercising public authrity t the Administrative Curt. Further right f appeal maybe made t the Ombudsman and the Minister f Justice. 2.2 Impact f the PSI Law The impact f Directive 2003/98/EC within Finland has been minimal. As Finland stated (Ministry f Finance press release 1 st July 2005) that the Laws f Finland already met the framewrk set ut in the Directive 2003/98/EC ne wuld perhaps expect t see a thriving ecnmy based n the re-use f PSI, hwever there is n evidence that Finland has a better-develped PSI re-use market when cmpared t ther cuntries within Eurpe which did nt have such a liberalised apprach t public sectr infrmatin. Hence the questin psed by Paav Palheim in his pening remarks. 2.2.1 Cmplaints At the time f the meeting there was n recrd f any cmplaints r appeals related t the re-use f public sectr infrmatin althugh cmpanies perating in the meterlgical sectr have expressed cncerns within the epsiplus first PSI pricing meeting 13 held in Helsinki during April 2007 - fr example Freca Limited 14. The FCA Annual reprt fr 2007 des hwever bliquely refer t the need t ensure that the public sectr des nt distrt cmpetitin when ffering prducts and services n the pen market. The FCA des refer t public sectr prcurement and that the public sectr needs t ensure that they are nt distrting cmpetitin thrugh specificatins that may favur ne part f the supply chain. 2.3 Scpe t extend the cverage f the Directive As law 621/1999 cvers a brader spectrum f public sectr bdies than that required in Directive 2003/98/EC there is n immediate call within Finland fr the scpe f the Directive t be bradened. There is hwever a call frm the ptential PSI and re-users and the ecntent sectr fr imprved implementatin f the Directive within Finland. 2.4 Strengths-Weaknesses Analysis 2.4.1 Strengths Finland has a lng histry f prviding access t public sectr infrmatin and the laws that are in place n the statute bk cmbined with the Infrmatin Sciety and Innvatin strategies prvide a gd framewrk fr the PSI re-use market t develp. 2.4.2 Weaknesses Althugh the Ministry f Finance has respnsibility fr the implementatin f the PSI Directive there was n evidence available at the time f the meeting that the Ministry was actively engaged in prmting and mnitring the effectiveness f Law 621/1999 as amended with respect t PSI re-use. Law 621/1999 at the time f the meeting makes n reference t Directive 2003/98/EC r the develpment f standard licences. Law 621/1999 des require public bdies t have indexes (r registers) that enable infrmatin held by each public bdy t be easily lcated and made available. As a result f this gd Infrmatin management practice the requirement within the Directive fr PSI Asset lists t be made available shuld be met. Finland has n PSI Regulatr that wuld ensure the key aspects f the PSI re-use framewrk as set ut in Directive 2003/98/EC have been delivered and cmplied with. Law 621/1999 meets a number f the requirements set ut in Finland s Cnstitutin as well as EU Directives related t access t public sectr infrmatin and as a result the ecnmic aspects f Directive 2003/98/EC may have becme secndary and lst. At the time f the meeting Finland had n central PSI re-use infrmatin prtal which if present culd help ptential PSI re-users especially thse frm utside Finland where crss-brder applicatins and services maybe develped. At the time f the meeting it was nt apparent hw exclusive arrangements if they existed wuld be phased ut by the 31 st December 2008 and which law r guidance was present t ensure exclusive arrangements are nt entered int and hw t determine whether such arrangements culd be deemed t be in the natinal interest. 2.5 Future develpments A useful additin t what already exists in Finland wuld be a tabulatin f hw the varius laws f Finland cmply r meet the PSI re-use framewrk as set ut in the EU Directive 2003/98/EC. At the time f the meeting there was evidence that a frmal PSI stakehlders grup 15 was beginning t frm which culd act as a catalyst with respect t raising the awareness f PSI re-use and its ptential ecnmic value and als t make recmmendatins t the Gvernment n the actins needed t ensure Directive 2003/98/EC met its stated bjective. Only a few public bdies make reference t Direktiivi 2003/98/EY (r Directive 2003/98/EC). A ntable example is the Finnish Maritime Administratin (FMA) 18 web site, which n the Cpyright and Permissins web page includes reference t the Directive 19, refers t the prcess fr seeking permissin, the timescale (usually within 14 days), and the price lists 20. The Ministry f Finance published during May 2007 an interim reprt 21 frm the prject cnsidering the Finland s public sectr Infrmatin Architecture. The reprt at paragraph 3.2.4 n page 19 refers t the implementatin f the PSI Directive within Finland and cncludes that the implementatin is deficient in that articles 7, 8 and 9 f the Directive (Transparency, Licences, Search facilities, and asset lists) are missing but if they were present they wuld nt nly assist with the cmmercial explitatin f public sectr infrmatin but als wuld help significantly t the sharing f data within the administratin itself, a win-win situatin fr bth sides f the supplydemand interface! 3.3 Value chain 3.3.1 Mdernising gvernment (egvernment) Since 1994 the Gvernment f Finland has made steady prgress twards mdernising f gvernment thrugh the explitatin f ICT as part f a wider initiative t develp the Finnish Infrmatin ecnmy. Internatinal cmparisns place Finland amngst the leaders alng with ther Nrdic cuntries. Since 1995 the Gvernment f Finland has had three Infrmatin Sciety prgrammes. The current prgramme (The third prgramme) was published by the Prime Minister s Office in September 2006 titled - A renewing, human-centric and cmpetitive Finland, September 2006, The Natinal Knwledge Sciety Strategy 2007 2015. It will be ensured that public administratin data is easily available in all public rganisatins. Citizens infrmatin needs will be attended t and it will be ensured that businesses can take advantage f databanks cmpetitively. Guidelines fr infrmatin disclsure and shared use will be clarified and the related issues f respnsibility will be harmnised. Technlgical interfaces and public electrnic services fr businesses will be develped. T develp and mnitr the implementatin f the actin plan the Gvernment appinted the Ubiquitus Infrmatin Sciety Advisry Bard 22. The Actin plan was published in 2008 titled: Ubiquitus Infrmatin Sciety Actin Prgramme 2008 2011. 23 Finland s Infrmatin prgrammes have been led by the Prime Minister and supprted by persnnel within the Prime Minister s Office. The Gegraphic Infrmatin prtal fr Finland is als taking shape. 3.3.2 Public Sectr Infrmatin Hlders The Assciatin f Finnish Lcal and Reginal Authrities The Assciatin f Finnish Lcal and Reginal Authrities 29 is made up f the cities, and municipalities in Finland. The Assciatin als prvides services fr hspital districts, reginal cuncils and jint authrities. The Assciatin is a member f the Cuncil f Eurpean Municipalities and Regins (CEMR). The Ppulatin Register Centre The Ppulatin Register Centre 30 fr Finland is respnsible fr amngst ther thematic areas the Address System in Finland. The Eurpean Unin epractice infrmatin prtal published 31 in Octber 2006 a case study titled - The Finnish Address System that describes the Address data and infrmatin in Finland. A wide range f public and private sectr bdies regularly update their Address registers using changes frm the Ppulatin Infrmatin System 32. Statistics Finland Statistics Finland reprts t the Ministry f Finance and as such prvides an example as t whether public sectr bdies in Finland cmply with the Directive 2003/98/EC as well as whether the Ministry f Finance is actively mnitring public sectr bdies especially thse that reprt t the Ministry. The Statistics Finland web site page titled - Applicatin fr a licence t use statistical data 33 wuld indicate that Statistics Finland is nt cmplying with the Directive n a number f cunts. 3.3.3 Public Private Partnerships Evidence that Public Private Partnerships (PPP) exist with respect t delivering infrmatin services particularly at a lcal r reginal level was presented during the natinal PSI meeting and in the full Mindtrek 2007 Cnference. The presentatin frm Destia titled: Public Private Partnerships and Traffic Infrmatin as a medium fr lcal based services presented a case study n the Oulu Regin Traffic Infrmatin service OLLI 34. The lcal municipalities, the Finnish Rad Administratin, the Ministry f Traffic and Cmmunicatins and the private sectr jintly fund the service. The service cvers all f the traffic infrmatin in the Oulu area. The respnsibilities within the partnership were described as: Public sectr cncentrates n steering and galkeeping and nt invlved in specificatin f services and prject managing. At the time f the meeting it was t early t establish what the cmbined impact f these varius initiatives has been r wuld be. It was nticeable hwever that the activities within Finland related t the transpsitin and implementatin f the INSPIRE Directive 2007/2/EC were far mre practive than the activities related t the transpsitin and implementatin f the PSI Directive 2003/98/EC. Bth Directives have resulted in the inclusin f actin lines in the current Infrmatin Sciety strategy and again it is nticeable that the prcess related t these actin lines are mre transparent with respect t the INSPIRE Directive when cmpared with the PSI Directive. 3.5 Strengths-Weaknesses Analysis 3.5.1 Strengths The tp dwn driven plicies with respect t develping and sustaining the Infrmatin Sciety and Knwledge ecnmy include the re-use f public sectr infrmatin and have identified the specific actins that need t be taken as well as thse respnsible fr delivering the actins. 3.5.2 Weaknesses Very few public sectr bdies web sites refer t the re-use f the infrmatin and under what cnditins. T many public bdies request the ptential re-user t cntact them. The public bdies as a result shw that they have nt appreciated the need fr being pr-active and transparent as required by the Directive 2003/98/EC. A ptential reasn fr this is that there has been n specific prmtin f the PSI Directive and its bjectives. Ministry f Finance dcuments published related t the public sectr infrmatin architecture acknwledge a number f the weaknesses with the implementatin f the Directive within Finland. 3.6 Future develpments During the meeting the representative frm the Ministry f Finance reprted that the specific pints raised during the meeting wuld be cnsidered within the Ministry.
