In the three annes to the answer, countres to whch multlateral mport treatment s appled, applcaton form for obtanng mport lcences as well as the tts of the Lav on Safeguardng Foregn Trade (157/63) and the subsdary Decree (l62/7k as amended n 19TU-19ÔO) are gven. The Fnnsh Government wshes to pont out that when sgnng the Agreement on Import Lcensng Procedures, all Fnnsh legslaton was n complance wth the Agreement, and therefore no changes to that legslaton had to be made. The Permanent Msson wshes n ths connon also to refer to the notfcaton of 3 July 1980 (Permanent Msson's note No. 2378) concernng the Import System of Fnland, and to Permanent Msson's note No. 2Hll of 30 July 1980. 3.2 Document LIC/1/Add.4/SuppL,1 reads as follows: Outlne of systems 1. The mport lcensng régmes used n Fnland are automatc mport lcensng and mport lcensng procedures for the admnstraton of quotas and ndvdual (dscretonary) lcensng. 2. The mport lcensng régmes can be dvded nto fve groups as follows: A. Global lcensng for the admnstraton of quotas for certan agrcultural products, petrol, slver and gold from countres wth multlateral trade systems. B. Indvdual (dscretonary)lcensng for the mport of certan agrcultural products, ol and coal from countres wth a multlateral mport system and for the mport from socalst countres wth whch Fn and has concluded an agreement on the recprocal removal of obstacles to trade. C. Indvdual (dscretonary) lcensng under blateral trade agreements. D. Indvdual (dscretonary) lcensng from countres other than A, B and C above. E. Automatc lcensng.

D. Indvdual lcensng apples to the mport of all products from countres not mentoned under A, B or C above. E. Automatc lcensng s operated for survellance purposes for certan ttle and steel products, f not otherwse stated n Fnnsh trade agreements. Lcences are granted automatcally. 5. The mport lcensng regmes descrbed above are used for the operaton of Fnnsh lcensng systems accordng to the Lav on Safeguardng Foregn Trade (157/73) and the subsdary Decree &62/7k as amended n 197^-1980). The Lav contans the man prncples applcable to regulatng foregn trade. The Decree specfes the products subject to mport lcensng systems, vhch cannot be abolshed vthout legslatve approval. Procedures 6. (a) Informaton on annual global quotas s publshed n the offcal publcaton of the Import and Export Permts Offce. The amounts publshed are global quotas as to quantty or value and are not allocated to goods from any specfc country mentoned under A above. Informaton on the mport system of Fnland can be obtaned through the GATT secretarat and through the Fnnsh embasses and trade mssons abroad. (b) The sze of the quotas s determned on annual bass. Lcences are usually ssued for mports for three months durng the calendar year. The valdty of these lcences can be prolonged. After usng the granted lcence the mporter must apply, for a nev lcence. (c) Lcences are ssued to all mporters alke. The system of grantng lcences for three months makes t possble to control the actual use of granted lcences. Lcences should be returned to the Import and Export Permts Offce after ther pry date or after the mport has been effected under a granted lcence.
Page 6 Unused allocatons may be dvded among other mporters durng the calendar year, but are not added to quotas of the followng year. The lcences granted to each mporter are publshed by the Import and Export Permts Offce. (d) Applcatons can be submtted before or durng a calendar year. However, the amnaton of applcatons for lcences does not take place untl the frst day of the calendar year n queston. (e) 1-lU days. (f) Applcatons can be made at any tme durng the year (see answer under (d). (g) The Import and Export Permts Offce n Helsnk admnstrates the mport lcensng régmes applcable as the only admnstratve lcensng authorty. (h) If the demand for lcences cannot be fully satsfed, the allocaton of quotas s carred out on the bass of past mport performance. A reasonable amount, about 10 per cent, of each quota s reserved for new mporters. If the mporter needs a smaller share, hs theoretcal unused amount s dvded between other mporters n proporton to ther past performance. Applcatons are amned on recept. () In the case of arrangements, where port permts are ssued by portng countres, mport lcences are not usually requred. (j) The nformaton procedures are usually agreed upon n the blateral agreements. (k) Import lcences are sometmes ssued on the condton that the product should be ported and not sold n the domestc market. 7. Applcatons for the mport of products under the automatc lcensng régme under E may be flled at any tme to the Import and Export Permt!* Offce. The appled lcence s granted n 1-2 days. 8. Reasons for a refusal are always communcated to the applcant. The applcant may renew hs applcaton for a lcence n the event of refusal. He has also a rght of appeal to the Survellance Body on Lcensng Affars. Elgblty to mporters to apply for lcence 9- (a-b) All persons, frms or nsttutons engaged n busness actvtes n Fnland are elgble to apply for lcences for products n ther sectors. There s no authorzaton of mporters, nor any regster of authorzed ones.

The applcaton should nclude the followng data: name and address of applcant, commodty, 3TN poston, quantty and amount of currency requred, country of consgnment, country of purchase and country of orgn, pected tme of mportaton and payment terms, sales condtons. The applcaton form s n Ann B. 11. Upon actual mportaton the followng documents are requred: - nvoce - customs declaraton - declaraton of dutable value - mport lcence. 12. The lcensng fees vary from Fmk 10 to Fmk kko dependng on the value of the products to be mported under a lcence. 13* There are no depost or advance payment requrements assocated wth the ssue of lcences. Condtons of lcensng lh. The perod of valdty of a lcence s usually three months. It may be tended subject to the mport perods f the lcence s presented for renewal before pry date. 15. No. 16. Lcences are not transferable wthout approval by the Import and Export Permts Offce. 17- No. Other procedural requrements 18. No. 19> Lcence s requred as a condton for obtanng foregn change for products under non-automatc lcensng systems. Foregn change s avalable to cover lcences ssued. Foregn change s granted by the Bank of Fnland upon applcaton.
