SPECIAL REPORT NO 4/2014 (2013 DISCHARGE) "INTEGRATION OF EU WATER POLICY OBJECTIVES WITH THE CAP: A PARTIAL SUCCESS" The overall audit question addressed by the European Court of Auditors was: Have the EU s water policy objectives been successfully integrated into the Common Agricultural Policy? The audit examined in particular whether the EU s water policy objectives were properly and effectively reflected in the CAP, both at strategy and implementation levels. This was done through an analysis of two instruments which are being used to integrate the EU s water policy objectives into the CAP: cross-compliance and the rural development fund. The Court concludes that the Commission and the Member States have only been partially successful in integrating the EU's water policy objectives into the CAP. This is due to a mismatch between ambitious policy objectives and the ability of the instruments used to effect change. The audit highlights weaknesses both in the design and application of cross compliance and in the use of rural development funding and points out delays and weaknesses in the implementation of the water framework directive. The Rapporteur insists on the fact that water policy is essential for long term well-being across the EU and must be a key element within EU sustainable development. A comprehensive and consistent approach is essential under the CAP to ensure full respect in the implementation of the Water Framework Directive (WFD) at all levels, from river basin to farm. Partial replies have already been given by the Commission but high standards of evaluating and monitoring are required in the new funding period 2014-2020, with the adoption and use of better analytical tools where these are needed. The Commission has to play its mission of guardian of the Treaty in terms of the relevant legislation including the PE544.271v01-00 8/13 PV\1042486.doc
WFD and the Nitrates Directive. The Rapporteur endorses the main recommendations issued by the Court and stresses in particular, that: at policy level, the Commission should propose to the EU legislator the necessary modifications to the current instruments (cross compliance and rural development) to ensure compliance with the WFD or, where appropriate, the introduction of new instruments capable of meeting the more ambitious goals with respect to the integration of water policy objectives into the CAP. the Member States should in compliance with the WFD: - address the weaknesses identified by the audit in their performance of cross compliance checks; - impose systematically the appropriate penalties in cases of infringement; - put more emphasis on identifying and addressing water-related problems through their Rural Development Programmes (RDP's) and ensuring they are consistent with their River Basin Management Plans (RBMP's); - devise and rigorously implement safeguard mechanisms to avoid negative side-effects on water activities financed by rural development; - more actively consider and promote the use of the funds earmarked for water-related issues in a way that is consistent with sound financial management. Auditors responsible, Ladislav Balko Ingeborg Gräßle CONT Chair Derek Vaughan CONT Vice-Chair responsible CONT Timetable: Consideration of draft report on 2013 Commission Discharge: 23/02/2015 Deadline for amendments: 03/03/2015 Adoption in CONT: 23/03/2015 Plenary vote: April II 2015 On 5 November 2014 the European Court of Auditors (ECA) presented its Annual Report 2013. In chapter 5 (regional policy, transport and energy) the ECA examined 180 transactions from 19 Member States. The ECA estimates the most likely error rate to be 6,9%. The most common errors relate to non-compliance with EU and/or national public procurement rules when awarding contracts and to the funding of projects which are not eligible or which do not comply with EU state aid rules. A further risk is that beneficiaries declare costs which are ineligible according to the regulations and/or national eligibility rules. It is noteworthy that if national authorities had used the information available to them (for example, from the final beneficiaries, their auditors or from the national authorities' own checks) to prevent, detect and correct the errors before declaring the expenditure to the Commission the most likely error estimated for this chapter would have been 3 percentage points lower. The documents of particular relevance for the exchange of views as regards the 2013 Commission discharge are: - The ECA's 2013 Annual Report - Chapters 1 and 5. - The Commission's follow-up report COM (2014)607 final and SWD (2014) 285 and 286. - The respective Annual Activity Reports of the respective Directors General. These documents are available on the CONT website. For this meeting Members submitted 95 written questions. In accordance with the timetable for the discharge procedure, the written questions for this meeting were sent to the Commission on 26 November 2014 and e- mailed to Members on the same day. Members also received a revised version of the questionnaire on 1 December. The answers from the Commission should arrive on 4 December and will be emailed to Members immediately. NANCIAL RULES APPLICABLE TO THE GENERAL BUDGET OF THE UNION Following the adoption of the Directives on public procurement and on the award of concession contracts (2014/23 and 24 EU), provision should be made for the rules contained in these Directives to apply to contracts awarded by the European institutions on their own account. The modifications brought about to the text of the Financial Regulation (FR) can be classified into three main groups. The first set of changes is linked to the alignment with the Directive. The second set of changes concern the articles on exclusion. The grounds for exclusion of an economic operator from procurement procedures are clarified and aligned with the Directive as well as the possibility for the economic operator concerned to take remedial measures. Exclusion is clearly distinct from the rejection of an economic operator from a given procedure in order to avoid confusion. A single system is established to allow for increased protection of the Union's financial interests which takes into account the existing Central Exclusion Database. The aim of the system is to ensure the early detection and prevention of risk as well as the publication of information related to excluded economic operators. A panel is set up to take exclusion decisions after the analysis of a case and it guarantees the right of defence of economic operators. The third set of changes is linked to clarifications of the text and simplifications. CONT is particularly interested by the second set of changes. The Rapporteur for opinion welcomes in general those provisions aimed at better protecting the financial interests of the Union. He tables amendments in order to include "tax evasion" as an exclusion ground in public procurement procedures PV\1042486.doc 11/13 PE544.271v01-00
(amendment 4), to further define the composition and principle of the action of the panel (amendment 6) and an amendment concerning the files in indirect management (amendment 9). He introduces 4 amendments aiming at finding the best balance possible between the financial rules (FR) and its rules of application (RAP) in particular as regards the rights of defence (see amendments 1, 5, 7 and 8). He intends to introduce in the FR new provisions corresponding to the political agreement reached between the Commission, the Council and the Parliament on 29 May 2014 regarding the principle of a separate discharge for the Joint Undertakings (amendments 2 and 14). The Rapporteur also introduced 4 amendments aiming at making the ECA audit activity more efficient, providing more transparency to the IAS activity (amendments 3, 10, 11, 12) and one amendment on the Council discharge ( amendment 13).
